RECITALS Church owns two parcels of land in Ada County, Idaho that share a common boundary. A church is built on one of the parcels. The other parcel is bare land. Church plans to turn the bare land into a parking lot and have parking area on both parcels. 1. DEFINITIONS: The following terms shall have the meaning set forth below for purposes of this Declaration: 1.1. Church Parcel: The Church Parcel as shown on the Site Plan and more particularly described in Exhibit B attached hereto and incorporated herein by this reference. 12. Parking Parcel: The Parking Parcel as shown on the Site Plan and more particularly described in Exhibit C attached hereto and incorporated herein by this reference. 1.3. Occupant: The occupant(s) of a Parcel under a lease or other occupancy agreement with the Owner of such Parcel. 1.4. Curb Cuts. Church acknowledges there is one existing access point between the Church Parcel and E. Commercial Court in the location shown as "Church Curb Cut" on the Site Plan. Church acknowledges there is one existing access point between the Parking Parcel and E. Commercial Court in the location shown as "Parking Curb Cut' on the Site Plan. Church plans to keep at least one access point between the Church Parcel and E. Commercial Court and one access point between the Parking Parcel and E. Commercial Court. 3.3. Prescriptive Rights.
