Two points of clarity and comment: First – The submitted site plan did not accurately identify the “qualified open space;” that inaccuracy was carried forward in the project narrative. Both required staff’s time to identify the error and to work with us through corrective iterations during the week. For that we apologize. - The attached site plan, with corrected open space calculations, shows 1.44 acres of open space (18.5%) on the 7.76-acre site, exceeding the required minimum; the subsequent DR and CZC process will validate compliance. Second – The application proposed amending the UDC to reduce the current “private usable open space” standard from 80 s.f. per unit to 60 s.f. —“unless that objective is possible through the CU or PUD process.” While our “unless” options appear not to be possible under the current UDC, staff has proposed a solution (middle of page 6, and Condition 1.1.3) with which we agree: - “As an alternative to the applicant’s request, Staff recommends UDC Table 11-5B-5, Alternative Compliance, is amended to include ‘private useable open space’ in Section 11-4-3-27B.3.” Thus, we will attend the hearing to support staff’s recommendation; to answer questions; and to request the Commission’s approval.
