H-2017-0103 ORDER OF CONDITIONAL APPROVAL OF TIME EXTENSION This matter coming on regularly before the City Council on August 22, 2017, upon the Applicant’s submittal of a short plat time extension application for a one (1) year extension within which to obtain the City Engineer’s signature on a final plat for Sugarman Subdivision, which short plat was originally approved on July 15, 2014, as provided in Unified Development Code § 11-6B-7C, and good cause shown. An administrative time extension (File #A-2016- 0222) for one (1) year was previously approved for this subdivision by the Planning Director on June 30, 2016 and would have otherwise expired on July 15, 2016. IT IS HEREBY ORDERED THAT: The above named Applicant is granted an additional one (1) year extended period of time, until July 15, 2018, within which to obtain the City Engineer’s signature on the final plat, subject to the conditions of approval as shown in the attached Staff Report for the hearing date of August 22, 2017 incorporated by reference. APPLICATION SUMMARY The Applicant, Columbia Trust, requests a one (1) year time extension (TEC) on the previously approved short plat (SHP) for Sugarman Subdivision in order to obtain the City Engineer’s signature on a final plat. II. STAFF RECOMMENDATION Staff recommends approval of the subject time extension, to expire on July 15, 2018, with the conditions included in Exhibit B. III. UNIFIED DEVELOPMENT CODE Per UDC 11-6B-7, approval of a short plat shall become null and void if the applicant fails to obtain the City Engineer’s signature on the final plat within two years of the approval of the short plat. Upon written request and filing by the applicant prior to the termination of the allowed time period, the City Council may authorize a time extension up to two years. With all extensions, the City Council may require the conditional use and/or plat to comply with current provisions of the UDC. VI. PROCESS FACTS A. The subject application is for a time extension. A public hearing is required before the City Council on this matter, consistent with Meridian City Code Title 11, Chapter 5. B. Newspaper notifications published on: August 4, 2017 C. Radius notices mailed to properties within 300 feet on: July 28, 2017 D. Applicant posted notice on site by: August 11, 2017 VII. HISTORY OF PREVIOUS ACTIONS:  This property received annexation and zoning (AZ-14-007) and short plat (SHP-14-001) approval from City Council 2014. A development agreement was required as a provision of annexation recorded as Instrument No. 2014-088000.  A 1 year time extension (A-2016-0222) on the short plat was approved by the Director on June 30, 2016. This approval extended the time period in which the applicant had to obtain the City Engineer’s signature on a final plat until July 15, 2017. VIII. STAFF ANALYSIS This is the second time extension requested for the subject short plat. Approval of the subject time extension will allow the applicant to continue obtaining signatures on the final plat and ultimately record the plat. If the subject time extension is not granted, the short plat application for this property would expire and a new short plat application would need to be submitted for City approval. Per UDC 11-6B-7C, with all extensions, the City Council may require compliance with current provisions of the UDC. The City recently adopted the Architectural Standards Manual, which contains design standards that are applicable to all new commercial development, and updated the structure and site design standards listed in UDC 11-3A-19. Additionally, the Applicant shall be required to comply with the most current Supplemental Specification and Drawings, and Design Standards of the City of Meridian. As conditions of the subject time extension, staff recommends future development of the subject property comply with the aforementioned requirements. Staff recommends approval of the applicant’s request with the aforementioned condition of approval. All previous conditions of approval are also still applicable to development of this subdivision. Conditions of Approval 1. The applicant is to meet all terms of the approved annexation (AZ-14-001), development agreement (Instrument #2014-088000) and short plat (SHP-14-001) for this development. 2. Future development of the subject property shall comply with the design standards in effect at the time of development. 3. Applicant shall be required to comply with the most current Supplemental Specification and Drawings, and Design Standards of the City of Meridian.
