The project directly benefits from its relationship with the City's regional pathway system within the Tenmile Creek corridor. The portion of that corridor from the intersection of Ten Mile and Franklin to this project is being platted in the TM Creek No. 2 final plat. The final plat encompassing this site, and a common lot for the adjacent pathway corridor, is forthcoming as noted in the "Future Project Actions" comments, below. Future Project Actions The final plat for the multi -family site is in design and will be submitted shortly, along with street and utility construction plans surrounding the site. Water and sewer stubs to the site were constructed in the project's first phase in both, W. Cobalt Drive and the service drive intersection on the project's west frontage. Thus, given the fixed horizontal and vertical locations of the streets, service drives and utility stubs already in place for access and service to this site, "conceptual engineering plans" are deemed to be not applicable and are not submitted with this application. Final engineering plans for connection to the streets and service drives and utilities will be submitted with the final plat for not only the subject parcel, but also for the Tenmile Creek corridor common lot and future abutting public streets. Development Agreement Modification The proposed multi -family project will be developed on property originally designated as retail when the project was annexed, zoned and approved in 2015. Therefore, a reduced, 8 1/2" x 11" copy of the up -dated TM Creek site plan is provided with this submittal for incorporation into an addendum to the project's development agreement. UDC Text Amendment: Section 11-4-3-27B.3 The UDC's "private, usable open space" requirement is addressed by patios and balcony spaces. The unique, urban -style architectural design of the buildings—in contrast to the typical garden -style apartments found throughout the area—along with the project's accessibility to the Tenmile Creek regional pathway corridor, has led to consideration of open space in the context of the individual units as related to the site's amenities. n Thus, the design of the TM Creek apartments takes advantage of its physical location adjacent to the Tenmile Creek corridor. The project's open space, in combination with the enhanced amenities and features provided in the clubhouse complex more than addresses the "common" needs of the multi- family community. Private open space is provided in patio and balconies of 61 s.f. for the one -bedroom units and 63 s.f. for the two-bedroom units, in contrast to the City's requirement of a "minimum of eighty (80) square feet. " In order to validate the proposed area reduction, a search of community standards was undertaken, leading to the conclusion that there are no clear, unambiguous standards in the multifamily industry or in the various municipal codes. Anecdotal responses to a HOUZZ website survey of apartment balcony sizes ranged from 24 sf (4x6) to 90 sf (12x7 1/2) with most in the 40-50 sf range. One publication by MRSC — Local Government Success, entitled Providing for Usable Open Space, or Multifamily Developments, compares the requirements of four cities in the Seattle, Washington, area. While not every community has an area standard, the three that do vary greatly, from 35 sf (Tacoma) to 50 sf (Bellevue) to 60 sf (Seattle). The TM Creek apartment's patio and balcony space, at a proposed minimum of 60 square feet, will be restricted to outdoor seating and enjoyment; bicycle storage and BBQ areas are provided elsewhere in the complex. Thus, we propose that Meridian UDC 11-4-3-27: MULTI -FAMILY DEVELOPMENT: Section B. Site Design: Sub -section 3, be amended as follows: "A minimum of six 60 square feet of private, usable open space shall be provided for each unit. This requirement can be satisfied through porches, patios, decks, andlor enclosed yards. Landscaping, entryway and other accessways shall not count toward this requirement.
