This letter is to confirm that the Director approved the application you submitted for a one (1)
year time extension on the preliminary plat for Kentucky Villas Subdivision in order to obtain
the City Engineer's signature on a final plat on or prior to August 3, 2018.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before August 23, 2017, within fifteen (15) days
after the written decision is issued, and contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.

The applicant, Bruce Hessing, requests approval of a one (1) year time extension on the preliminary
plat in order to obtain the City Engineer's signature on the final plat for Kentucky Villas Subdivision
(PP -15-009). The plat consists of 8 building lots, I common area lot and 1 other lot on 3.87 acres of
land in the R-4 zoning district.
The reason for the request is this developer purchased the property in December of 2016 and received
final construction approval from the City in May of this year but has been unable to finalize the
improvements prior to the expiration date of the plat. See Applicant's narrative for more information.
IL STAFF RECOMMENDATION
Staff recommends approval of a one (1) year time extension as requested in order to obtain the City
Engineer's signature on the final plat for Kentucky Villas Subdivision to expire on August 3, 2018.
III. APPLICATION AND PROPERTY FACTS

at 835 W. Victory Road, in the northwest 1/4 of Section 25, T. 3N., R. 1 W.

IV. HISTORY OF PREVIOUS ACTIONS
This property was annexed as part of the Victory South Category B annexation (AZ -13-014) in 2013
and a preliminary plat was approved in 2015 for Kentucky Villas Subdivision (PP -15-009). A final

plat (FP -15-027) was approved in 2015 and will expire on August 11, 2017 unless a time extension is
approved or the final plat is signed by the City Engineer.
V. UNIFIED DEVELOPMENT CODE (UDC)
Per UDC I1-613-7, approval of a preliminary plat shall become null and void if the applicant fails to
obtain the City Engineer's signature on a final plat within two years of the approval of the preliminary
plat.
In the event that the development of the preliminary plat is made in successive phases in an orderly
and reasonable manner, and conforms substantially to the approved preliminary plat, such segments,
if signed by the City Engineer within successive intervals of two years, may be considered for final
approval without resubmission for preliminary plat approval.
Upon written request and filing by the applicant prior to the termination of the allowed time period,
the Director may authorize a single extension of time to obtain the City Engineer's signature on the
final plat not to exceed 2 years. Additional time extensions up to 2 years as determined and approved
by the City Council may be granted. With all extensions, the Director or City Council may require the
plat to comply with current provisions of the UDC.
VI. STAFF ANALYSIS
This is the first time extension requested on the subject preliminary plat. Approval of the subject time
extension will allow the applicant to proceed with obtaining the City Engineer's signature on the final
plat and recording the plat. If the subject time extension is not granted, the preliminary plat will
expire and a new preliminary plat(s) application will be required.
Since the time this preliminary plat was approved, there haven't been any changes to the UDC that
would impact development of this site. Therefore, no new conditions of approval are recommended.
The applicant should comply with all previous conditions of approval for this site.
Staff recommends approval of the requested one year time extension of the preliminary plat.
