APPLICATION SUMMARY The applicant is requesting approval to vacate a portion of the 10-foot wide public utility, drainage and irrigation (PUDI) easement located between Lots 4 and 5 of Block 4 and Lots 4 and 5 of Block 5 platted with Troutner Park Subdivision No. 2, as well as a section of right -of-way of SW 3rd Avenue, south of W. Pennwood Street. The PUDI easements runs north/south along the lot lines of Lots 4 and 5 of Block 4 and Lots 4 and 5 of Block 5. The right-of-way for SW 3rd Avenue currently extends approximately 120 feet south of W. Pennwood Street, and is approximately 54 feet wide. 2. STAFF RECOMMENDATION Staff recommends approval of the subject vacation applications. 3. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located on west of N. Meridian Road between W. Corporate Drive and W. Pennwood Street in the NE ¼ of Section 13, Township 3 North, Range 1 West, B. M. Troutner Park Subdivision No. 2 – H-2017-0045 - 2 - B. PROCESS FACTS The subject application is a request to vacate a platted easement created with Troutner Park Subdivision No. 2, and to vacate a section of right-of-way for SW 3rd Avenue approximately 120 feet by 54 feet. Per Meridian City Code Title 11, Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the site to be posted with a public hearing notice sign. A. Newspaper notifications published on: April 28, 2017 B. Radius notices mailed to properties within 300 feet on: April 21, 2017 6. LAND USE A. Existing Land Use(s): This property is a commercial lot that has received CUP approval to construct a multi-family development. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is primarily developed with single family residences, zoned R-1 and RUT in Ada County. C. History of Previous Actions:  In 2008, this property was platted as part of the Trade Plaza preliminary plat (PP-08-011).  In 2016 a preliminary plat was approved consisting of fifteen (15) multi-family residential lots and five (5) common lots; a conditional use permit was also concurrently approved for the property to have 90 multi-family units (H-2016-0041).  Also in 2016, a final plat was approved consisting of fifteen (15) multi-family residential lots and five (5) common lots (H-2016-0107).  Also in 2016, a CUP was approved for a multi-family development consisting of 180 multi- family units on approximately 7.52 acres in the C-G zoning district. 7. AGENCY COMMENTS MEETING No comments were received by the Planning Division from other City departments for the subject application. 8. STAFF ANALYSIS State statute 50-1306(A) gives the city Council the authority to grant vacations within one (!) mile of the city’s jurisdiction. The applicant requests approval to vacate two 10-foot wide public utility and drainage easement that runs north/south along the property lines, as well as an approximately 120 foot by 54 foot section of right-of-way for SW 3rd Avenue. Once the vacation process is complete, the applicant proposes to construct a multi-family structure across each of the proposed PUDI easement vacations and plans to use the vacated right-of-way for access as shown in the approved site plan (see Exhibit A.4). The Troutner Park Subdivision No. 2 – H-2017-0045 - 3 - PUDI easements must be vacated prior to commencing and construction on the associated lots. The applicant has received approval from all of the applicable public utilities (Idaho Power, Century Link, Cable One, Intermountain Gas, and Nampa Meridian Irrigation District) to vacate the easement and from ACHD for the right-of-way.
