Vivid Sky Drive — Lot 17, Block 12, Reflection Ridge No. 5 Honorable Mayor and City Council Members: On behalf of Mission Coast Properties ID, Inc. please accept this application for the vacation of a Slope Easement on Lot 17, Block 12 of Reflection Ridge No. 5 Subdivision. The slope is entirely within the subject lot owned by the developer of Reflection Ridge, Mission Coast Properties ID, Inc. The vacation of the slope easement will not require the adjustment of existing Public Utility easements on the lot lines as they will remain as shown on the recorded plat. A public hearing is not required per state law for the slope easement vacation. In previous phases of Reflection Ridge, slope easements were indicated on certain lots where the developer desired to install HOA maintained grass on large slopes between tiers of lots. In other locations where the private homeowner owned and maintained the slope, slope easements were not necessary and were not indicated on the final plat. In many of those cases, the builder/homeowner chose to modify the slope with the addition of retaining walls to increase the usable yard and flat buildable area of the lot. On this particular lot, the slope easement should not have been indicated on the final plat. The slope at this location is privately maintained similar to dozens of previous lots in Phases 1 through 5 of the Reflection Ridge Subdivision. With the approval of the slope easement vacation, the private builder/homeowner will be allowed to modify the extent of the slope with a rock retaining wall, subject to standard City of Meridian building permit requirements and wall setbacks. Upon approval, the project surveyor will file an affidavit with the Ada County Recorder modifying Note 11 on the recorded plat to exclude Lot 17, Block 12 from the list of lots subject to the slope easement.
