In response to your Agency and Department Comments we are in agreement as follows:

Items 1.1.3 - Unsure what this item states is requesting
Item 1.1.4 and Item 1.1.5a - We request that the Department consider allowing structures (parking
and one trash enclosure) to encroach 7’ into the 25’ buffer space. We request this alternative
compliance because of our unique conditions as follows:
1. The wall formed by the storage facility completely separates commercial and residential uses
and eliminates sounds and views from one land use to another. Therefore, the buffer in this
unique condition provides very limited aesthetic benefit other than screening and softening the
reasonably attractive site wall.
2. The guest parking and trash enclosure are very needed for the convenience of users along the
west side of the multi-family development.
3. 18’ is enough room to adequately landscape and soften this corridor.
4. Both uses are within the same development.
1.1.5.b - Agreed, we have attached a revision exhibit showing the requested sidewalk connection
from Agpar Creek Drive sidewalk to McMillan Drive sidewalk.
1.1.5. c thru 1.1.5 i – Agreed
1.1.5.j and 1.1.5.k In our meeting with staff regarding this staff report it was agreed that because
the Selway Units face the 25’ buffer space it may be better to not have fencing along this northern
boundary as long as this meets with the approval of Kelly Creek HOA.
1.1.5.l and 1.1.5.m – Agreed, we have submitted plans and preliminary details to Republic Services
for comment and review.
1.1.6 and 1.1.7. and 1.1.10 - Agreed, we have attached images for the amenities. We wish to change
the “Art Piece” amenity to a “Community Garden” and will add bike lockers as a fifth amenity. Staff
seemed to be in agreement of this amenity package.
1.1.8. - Agreed
1.1.9. - Agreed, we have provided staff with an approved open space calculation plan
1.1.10 - Agreed (see 1.1.6)
1.1.11 - Agreed
1.1.12 and 1.1.13 - Agreed, revised side and back elevations are attached to show added
architectural articulation.
1.1.14 – Agreed
We are also in agreement with the General, Ongoing and Process Conditions of Approval.
The developer is formally requesting the issuance of one building permit after entitlements for the
storage units. These will remain on one lot and the Developer would like to commence
construction as soon as possible.
