Dear Mr. Hood,
Enclosed is an application for modification of the TM Crossing project Development
Agreement as initially recorded on January 9, 2014 as Instrument #114045759; and
subsequently amended by Addendum to Development Agreement recorded July 13, 2016
as Instrument #2016-062220.
The City Council approved the original project Findings of Fact, Conclusions of Law, and
Decision and Order on October 2, 2012; approved the original Development Agreement on
January 7, 2014; and adopted the implementing ordinance on that same date, as Ordinance
#14-1588.
Related project files: CPAM-12-001, AZ -12-005, PP -12-003, TED -14-001, MDA 2016-0054, and
FP (H-2016-0099)
Specifically, this request proposes modification of the approved Phase I site plan, as attached
hereto, to encompass the site of the Paylocity Building; and to enable construction of said
building while the TM Crossing Subdivision No. 2 final plat is processed for recording prior
to occupancy.

Just to re -cap our conversation from last week, prior to issuance of building permit for this structure a development
agreement modification application needs to be submitted to allow development in the 2"d phase. Then, the final plat
for phase 2 needs to be recorded prior to issuance of Certificate of Occupancy for this structure. Alternative Compliance
needs to be applied for with the CZC/DES if the building height doesn't comply with the standards listed in UDC 11-213-
3A.3.

Subject: TM Crossing — Phase One Development Agreement Site Plan Modification
Phase One of TM Crossing was approved by the Meridian City Council last year and construction of the
first structure, the 2 -story An:eriben office building, is underway. Several others are scheduled to start
shortly, including one outside the approved Phase One boundary (see back of page).
As a result, we will modify the Development Agreement site plan to include that area. This does not change
the project plan, or proposed uses just the timing of building construction. The "Future Phase" denoted
on the back will be the subject of future neighborhood meetings, applications, and City Council hearing.
A meeting has been scheduled to discuss the Development Agreement modification; or you can call Mike
Wardle at 863-6150 if you have questions.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
