(hereinafter referred to as the g"Contractoi'll. 'WJTNESSETH WHEREAS, the Owner owns and controls the property upon which maintenance is, required. WHEREAS, the Owner desires to contractfor property maintenance services., NOW THEREFORE, in consideration of the pjernises, and of the mutual covenants and promises contained in 'this Agreement, it is hereby agreed by and between the Owner and the Contractor as stipulated bei. 1. The Contractor's Obliqations. The Contractor shall perform the following service& on th& Owners property located at 2975 Records Ave. meridian, Idaho 83646: a) The contractor shall board and SeCAUTe all DToperfies within T days of the acquisition or certificate of occupancy by the Owner b) The contractor shall provide major clean-uplout of the property, if required 'within 14 days of acquisition by the Owner The contractor shall perform the following routine maintenance procedures i. Mowing of each property every week during the mowing season. ii. Trash removal, as needed iii- Snow removal/clearance of sidewalks- as needed iv- Re -securing and boarding of property, as needed v. Painting if needed on any exterior buildings vi. Repair or replace any dilapidated fencing vii. Cleaning and maintenance of courtyard fountains viii. Weed and landscape maintenance, of all common areas ineJuding between structures, driveways and courtyard d) The contractor shall notify and seek approval to proceed by the Owner of needed repairs, which are outside the scope of routine maintenance described in subparagraph (c) above. e) The contractor shalt perform necessary repairsfmairitenance to the property at the request of the Owner and shall be entitled to payment therefore at the Contractors normal charge for service and materials - f) The contractor shall respond to a request for a nonscheduled service or maintenance call within 24 hours after receipt of such request. Term. This Agreement shall remain in effect until terminated. a) The owner has the right to terminate this Agreement by giving notice to the contractor thirty (30) days in advance of the date of termination. b) The contractor has the right to terminate this Agreement by giving written notice of intent to terminate this Agreement to the Owner thirty (30) days in advance of the date of termination. 4. Use of subcontractors. The contractor may subcontract with such maintenance contractors as it deems desirable to perform any of the contractor's duties under this Agreement, in accord with Sections 3, 5. Entire Agreement and Amendment. This Agreement supersedes all prior negotiations, agreements, and understandings between the Parties with respect to the subject matter hereof and constitutes the entire Agreement between the Parties with respect to the subject matter hereof. To be effective; any amendment or modification to this Agreement must be in writing and must be signed by both Parties.
