ORDINANCE NO. ~7~
AN ORDINANCE OF THE CITY OF MERIDIAN ENACTING A NEW
SECTION OF CHAPTER 7 TITLE 8, MERIDIAN CITY CODE OF THE CITY
OF MERIDIAN; PROVIDING FOR A NAME FOR THE PARK; RELATING TO
PARK REGULATIONS; PROVIDING FOR THE PURPOSES AND
AUTHORITY, DEFINITIONS; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Chapter 7 of Title 8 is hereby amended by the addition
thereto of a new Section 3 to read as follows:

PURPOSES AND AUTHORITY: This Section is for the purpose of
acknowledging the acceptance of additional land by the City of
Meridian for the park, lmown and designated as Chateau Park, the legal
description for which is herein set forth in this Chapter; and this
Chapter is enacted upon the authority derived from the Constitution of
the State of Idaho Article XII § 2 and from Idaho Code §§ 50-303, 50-
302, and for the health, safety and welfare of the public.
DEFINITIONS: For purposes of this Section, the following words
and phrases shall have the meaning ascribed to them in this Section:
CHATEAU
PARI(:
That certain Municipal park owned and operated by
the City of Meridian more particularly described as
follows:
Lot 1 in Block 14 of SUNNYBROOK FARMS NO. 4, according to the
Official Plat thereof, filed in Book 53 of Plats at Page(s) 4682 - 4683,
records of Ada County, Idaho.
Said parcel contains 2.1 acres, more or less.

AND
All that certain real property situated in Section 2, T.3N., R. 1W., B.M.,
Ada County, Idaho, described as follows:
A portion of the W lA of the E 1/5 of the SW 1/4 as shown on Record of
Survey No. 3916 filed as Instrument No. 97047432 dated June 16,
1997, of Ada County Records further described as follows:
Commencing at a found Brass Cap Monument marking the SW corner
of Section 2 from which a found Brass Cap Monument marking the 1/4
corner of Sections 2 and 11 bears South 88°38'31" East, 2,653.49 feet;
Thence South 88°38'31" East 1,326.75 feet to a set 5/8-inch iron pin
with cap stamped "G.A. Lee, PE/LS 3260", marking the W 1/16 corner
and the Southeast corner of Sunburst Subdivision No. 2 as filed in Book
60 of Plats, page 5894, Ada County Records;
Thence along the West 1/16 line and East boundary line of said
Sunburst Subdivision No. 2 and the East boundary line of Sunburst
Subdivision No. 4 as filed in Book 62 of Plats, page 6217, Ada County
Records, and the East boundary line of Kent Field Manor as filed in
Book 68 of Plats, page 6913, Ada County Records, North 00°17'24"
East, 2,144.15 feet to a found 1/2-inch iron pin with cap stamped "LS
4931" on the North right-of-way of West Chateau Drive, marldng the
Southwest corner of Parcel 3 and the REAL POINT OF BEGINNING;
Thence continuing along said West 1/16 line and said East boundary
line of Kent Field Manor North 00°17'24" East, 511.98 feet to a found
5/8-inch iron pin with cap stamped "LS 4931" marldng the CW 1/16
corner and the Northwest corner of said Parcel 3;
Thence along the 1/4 Section line South 89012'32'' East, 414.67 feet to
a set 5/8-inch iron pin with cap stamped "G.A. Lee, PE/LS 3260"
marMng the Northwest corner of Sunny Brook Farms No. 4 as filed
Book 53 of Plats, page 4682, Ada County Records, and the Northeast
corner of Parcel 3;
Thence along the West boundary line of said Sunny Brook Farms No. 4,
South 00o17'24'' West, 469.23 feet. to found 1/5-inch iron pin with no

cap on the North right-of-way of West Chateau Drive marldng the
Southeast corner of said Parcel 3;
Thence South 88°34'15'' West, 100.00 feet to set 5/8-inch iron pin with
cap stamped "G. A. Lee, PE/LS 3260";
Thence North 89042'36" West, 106.37 feet toa set 5/8-inch iron pin
with cap stamped "G. A., Lee, PE/LS 3260";
Thence along a tangent curve to the left with delta 19°59'16", radius
330.00 feet, tangent length 58.15 feet, arc length 115.12 feet and chord
bearing South 80o17'46'' West, 114.54 feet to a set 5/8-inch iron pin
with cap stamped "G. A., Lee PE/LS 3260" and marldng a point of
reverse curvature;
Thence along said reverse curve with delta 20°40'29'', radius 270.00 feet,
tangent length 49.25 feet, arc length 97.43 feet, and chord bearing
South 80038'23'' West 96.90 feet to found ~/5-inch iron pin with cap
stamped "LS 4931" marking the Southwest corner of said Parcel 3 and
KEAL POINT OF BEGINNING;
Said parcel contains 4.60 acres, more or less.
SUBJECT TO:
All existing easements and road rights-of-way of record or appearing on
the above-described parcel of land.
SECTION 2: All ordinances, resolutions, orders or parts thereof in conflict
herewith are hereby repealed, rescinded and annulled.
SECTION 3: VALIDITY: The Meridian City Council hereby declares that
any section,, paragraph, sentence or word of this Ordinance as adopted and amended
herein be declared for any reason to be invalid it is the intent of the Meridian City
Council that it would have passed all other portions of this Ordinance independent of
the elimination herefrom of any portion as may be declared invalid.

SECTION 4: SAVINGS CLAUSE: This Ordinance does not affect an action
or proceeding commenced or right accrued before this Ordinance takes effect.
SECTION 5: DATE OF EFFECT: This Ordinance shall be in full force and
effect after its passage, approval and publication, according to law.

AN ORDINANCE FINDING THAT CERTAIN LAND LIES CONTIGUOUS OR ADJACENT
TO THE CITY LIMITS OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE OF IDAHO;
AND FINDING THAT THE OWNER HAS MADE A REQUEST FOR ANNEXATION IN
WRITING TO THE COUNCIL; AND THAT SAID LAND BE ANNEXED TO THE CITY OF
MERIDIANAND ZONING DESIGNATED MEDIUM DENSITY RESIDENTIAL DISTRICT (R-
8); AND DECLARING THAT SAID LAND, BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW, BE A PART OF THE CITY OF MERIDIAN, COUNTY OF ADA, STATE
OF IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD

COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE SECTION 50-
223 AND SECTION 63-2215.
BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF
MERIDIAN, COUNTY OF ADA, STATE OF IDAHO:
SECTION 1. FINDINGS: That the following described land is contiguous and
adjacent to the City of Meridian, Idaho, and that the City of Meridian has received a written
request for annexation to the City of Meridian, Idaho, by the owner of said Property to -wit:
A parcel of land being the North half of the Southeast 1/4 of the Northeast 1/4 of
Section 18, T. 3N., R- IE., B.M., Ada County, Idaho, and more particularly described as follows:
Commencing at a brass cap marking the Northeast corner of Section 18, T. 3N., R. IE., B.M., Ada
County, Idaho; thence South 00031' 15" West along the Easterly boundary of said Section 18,
1,329.55 feet to an iron pin marking the North 1/16 corner of said Section 18, said point being the
REAL POINT OF BEGINNING; g
thence continuing along said Easterly boundary South 00-31'l5" West, 664.63 feet to a point;

thence leaving said Easterly boundary South 89°36'07" West, 1,326.23 feet to a point on the
Westerly boundary of the North half of the Southeast 1/4 of the Northeast 1/4 of said Section 18;
thence North 00°2939" East along said Westerly boundary, 660.00 feet to an iron pin marking the
NE 1/16 corner of said Section 18;
thence leaving said Westerly boundary North 89°39'40" East, 1,326.53 feet to the REAL POINT
OF BEGINNING.
Said parcel contains 20.26 acres, more or less.
SECTION 2: That the above -described real property be, and the same is hereby annexed
and made a part of the City of Meridian, Ada County, Idaho.
SECTION 3: That the real property herein by this ordinance annexed to the City of
Meridian hereinabove described shall be zoned Medium Density Residential District (R-8).
SECTION 4: That the City Engineer is hereby directed to alter all use and area maps as well
as the official zoning maps, comprehensive plan and all official maps depicting the boundaries of
the City of Meridian in accordance with this ordinance.
SECTION 5: The zoning designation set forth in Section 3 of this ordinance is subject to
the terms and conditions of that certain Development Agreement by and between the City of
Meridian and the owner of the land described in Section 1 dated the

SECTION 6: All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 7: This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law. g

SECTION 8: The Clerk of the City of Meridian shall, within ten (10) days following the
effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in
a draftsman manner plainly and clearly designating the boundaries of the City of Meridian,
including the lands herein annexed, with the following officials of the County of Ada, State of
Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a
certified copy of this ordinance and map with the State Tax Commission of the State of Idaho, all
in compliance with Idaho Code §63-2215 and §50-223.
