Hansen, Commissioner October 18, 2016 TO: ACHD Commission, Director Wong FROM: Gary Inselman, Development Services Manager SUBJECT: Property Dedication Agreement MEETING DATE: November 2, 2016 FINDINGS: 1. Four property owners with parcels north of Chinden Boulevard at Black Cat Road propose to dedicate right-of-way to ACHD for the future improvement of Black Cat Road and Tree Farm Way. 2. The four property owners (Grantor) include: Drew F. Eggers and Debra Eggers; Puma, LLC, represented by Drew F. Eggers, Member; MDC, LLC, represented by Douglas K. Carnahan, Manager; and H.O.T.3, LLC, represented by R. Orville Thompson, Manager. 3. Grantor proposes to dedicate land as an unopened public right-of-way to ACHD for the future construction of Black Cat Road and Tree Farm Way through a Property Dedication Agreement (Agreement). 4. Under the terms of the Agreement, ACHD shall have no obligation to maintain the unopened right- of-way and no obligation to construct Black Cat Road or Tree Farm Way. 5. The Agreement will facilitate the improvement of Black Cat Road and Tree Farm Way when necessary as development of Grantors parcels occurs. By dedicating the right-of-way, it is available for extension of utilities and improvement of Black Cat Road and Tree Farm Way with the development of Grantors parcels regardless of the order in which they develop. 6. Grantor agrees to design and construct Black Cat Road and Tree Farm Way within the right-of-way property to collector standards at Grantor’s sole cost and expense. 7. Grantor acknowledges that additional right-of-way will be required for the future Chinden Boulevard/Black Cat Road intersection per the ACHD Capital Improvements Plan through the development process. 8. The Agreement has been approved for form and content by the District General Counsel. RECOMMENDATION: Approve the Property Dedication Agreement and authorize the President of the Commission to execute the Agreement.
