APPLICATION SUMMARY The applicant, The Land Group, Inc., requests approval to vacate (VAC) the 5-foot wide property drainage, utility construction and maintenance easement along the shared side lot lines between Lots 2 & 3 and Lots 3 & 4, Block 5, Gemtone Center Subdivision No. 5. 2. STAFF RECOMMENDATION Staff recommends approval of the subject VAC application. 3. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located at 2425, 2463, and 2501 E. State Avenue in the NE ¼ of Section 8, Township 3 North, Range 1 East. Applicant's Statement/Justification: Please see applicant’s narrative for this information and the application file for the applicable relinquishment approvals. 5. PROCESS FACTS The subject application is a request to vacate a portion of a platted easement. Per Meridian City Code Title 11, Chapter 5, the City Council is the decision making body on this matter. The UDC does not require the site to be posted with a public hearing notice sign. A. Newspaper notifications published on: September 5 and 19, 2016 B. Radius notices mailed to properties within 300 feet on: September 1, 2016 6. LAND USE A. Existing Land Use(s): This property is currently being developed with a Rite Aid, zoned C-C. B. Character of Surrounding Area and Adjacent Land Use and Zoning: The surrounding area is primarily developed with single family residences, zoned R-8, R-4 and RUT in Ada County. C. History of Previous Actions: This property received preliminary plat (PP-02-028) approval in 2003 and final plat approval (FP-03-027) in 2003. Tentative approval of a property boundary adjustment (A-2016-0255) application was issued in August of this year for the consolidation of the subject lots; final approval is contingent upon approval of the subject vacation application. 7. STAFF ANALYSIS The applicant requests approval to vacate the 5-foot wide property drainage, utility construction and maintenance easement along the shared side lot lines between Lots 2 & 3 and Lots 3 & 4, Block 5, Gemtone Center Subdivision No. 5. These easements were created via the plat for this subdivision. There are no utilities within these easements. The applicant has received approval from all of the applicable public utilities (Idaho Power, Century Link, Cable One, Intermountain Gas, Nampa- Meridian Irrigation District, Settler’s Irrigation) to vacate the easement. Approval of the subject application will allow the applicant to obtain final approval of the property boundary adjustment (A-2016-0255) application to consolidate these lots and construct a building on the site. Staff recommends approval of the proposed VAC application as requested by the applicant in accord the legal description and exhibit map attached as Exhibit A.3. 8. EXHIBITS A. Drawings 1.
