Taylor AgreementAuthentisign ID: 69C1579D-8ESB-4EDA-94C2-1:)37B47DF5689 Memorandum of Understanding This Memorandum of Understanding (this `Agreement') is made and entered into by and between JLJ, Inc., and Idaho Corporation (Applicant for Logan Creek Subdivision), Roger and Teresa Taylor (owner of Lot 2 Block 1 Martine] Sub #96033702, 4606 S. Eagle Rd, Meridian, ID 83642), and Donald and Marie Morgan (owner of Lot 3 Block I Martinel Sub 497096095, 4620 S. Martinel Lane, Meridian, ID 83642). All Parties in this Memorandum of Understanding agree to the following: L At the expense to JLJ, Inc. will relocate the Northern stretch of the ditch as shown in Exhibit `A' located on the Taylor and Morgan property and will be relocated to be completely on the Taylor property and be constructed with concrete by a contractor approved by Taylor. JLJ, Inc. will also cover costs for prep work and dirt and will provide pipe and structure to transition from piped ditch to the open concrete ditch. JLJ, Inc. will also cover costs to relocate Taylor's existing fence to the location West of relocated open concrete ditch; location to be approved by Taylor. Completion shall be no later than December lst, 2016. 2. At the expense to JLJ, Inc-, will provide a 1.6' wide privacy gate that will be installed between the Taylor property and Logan Creek Subdivision along E. Taormina St_ for Taylor's access no later than December 15, 2016. Location shall be agreed upon by both parties prior to construction. Taylors agree to maintain said gate after installation. 3- Only single level homes shall be allowed to be constructed on lots 33, 34, 35, 36, 38, 39, 40 & 41 of Block 1 as shown and marked with checkmarks on Exhibit `A' in the Logan Creek Subdivision.. 4. All Parties agree that this document will be submitted to the City of Meridian and will become part of the conditions of approval for the Logan Creek Subdivision final plat. 5. Taylor agrees to the termination of the current Martine] Subdivision CC&R's recorded as instrument # 96080621 attached as Exhibit `B'. 6.
