Shoemaker AgreementAuthentisign ID: 26F91607-765F-4129-8BB8-BADFD7E24BDA Memorandum of Understanding This Memorandum of Understanding (this `Agreement') is made and entered into by and between JLJ, Inc., and Idaho Corporation (Applicant for Logan Creek Subdivision) and James and Helen Shoemaker (Owners of Parcel #R9827130180 legal description Par#0180 S'LY POR Lot 1 BLK 1 Zaldien Zerua Sub #0100S , located in Meridian, ID 83642). All Parties in this Memorandum of Understanding agree to the following: 1. Only a single level home shall be allowed to be constructed in the Logan Creek Subdivision on lot 5 block 2. This lot is identified with a checkmark in Exhibit `A'. 2. Only a single level home or single level with upstairs bonus room shall be allowed to be built on lots 3, 4, and 6 of block 2 in the Logan Creek Subdivision. These lots are identified with a checkmark in Exhibit `A'. If a single level with upstairs bonus room, requirements will be as follows: a. upstairs square footage shall be contained within the attic space of the first level b. bonus room square footage shall face the front of the home with windows and/or dormers also only located on front of home c. All dormers and windows on back of home must be designed for the first floor only 3. In the Shelburne Subdivision, the lots being conveyed by the developer of Shelburne to Shoemaker shall have specified restrictions. Said Shoemaker Lots are currently identified in a preliminary Plat of the Shelburne Subdivision in Exhibit `B' attached, as being lots 2, 3 and 4, Block 3. Lots 2 and 3 of Block 3 in the Shelburne Subdivision shown in Exhibit `B' shall adhere to the same restrictions as Logan Creek lots 3, 4 and 6, Block 2. Lot 4 Block 3 in the Shelburne Subdivision shown in Exhibit `B' shall adhere to the same restriction as lot 5 block 2 Logan Creek. If said lots in the Shelburne Subdivision do not adhere to stated conditions then the Logan Creek Subdivision shall not be held obligated to adhere to said conditions. 4. All Parties agree that this document will be submitted to the City of Meridian and will become part of the conditions of approval for the Logan Creek Subdivision plat.
