RE: Creason Creek Subdivision – H-2016-0087 (MDA)
On August 18th, staff met with the applicant to discuss the Creason Creek MDA application. A new
development agreement provision and exhibit has been prepared for City Council’s approval. Staff
recommends the following modification to Development Agreement provision C:
5.1 Owner/Developer shall develop the Property in accordance with the following special
conditions:
c. The Owner/Developer is allowed to commence construction of two (2) homes on the site,
one on each of the two existing parcels (S1201223065, and S1201223045) located on
future lots (Lot 15, Block 2 and Lot 5 Block 3) of Creason Creek Subdivision 1 as shown
in the attached exhibit. Access to these building sites shall comply with the Fire
Department’s standards and any other applicable life safety requirements. Including, but
not limited to having available live fire hydrants to provide fire protection. These
structures shall be located so that they comply with the setbacks of the R-8 zoning district
for the future platted lots. Prior to issuance of Certificate of Occupancy for these
structures, the final plat shall be recorded and all site improvements shall be completed
and accepted by the City.
As revised above, staff believes the modified development agreement provision along with the attached
exhibit should ensure that the minimum standards will be met to issue two (2) building permits as desired
by the applicant. Please note that the issuance of building permits prior to the Final Plat being recorded,
and the development improvements being substantially completed is outside of normal protocol and will
require additional staff involvement and staff time.
