Tribal Fire CZCCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: July 13, 2016 TO: Clarence Mclain, Tribal Fire Systems Llc FROM: C.Jay Coles, Assistant City Planner SUBJECT: Tribal Fire Systems — CZC, DES, ALT - A-2016-0166 OWNER: Clarence Mclain DESCRIPTION OF APPLICANT'S REQUEST The applicant, Clarence Mclain, requests Certificate of Zoning Compliance (CZC), Design Review (DES) and Alternative Compliance (ALT) approval of construction of a single story, 5,000 sf office and warehouse building (flex space) for light fabrication of fire sprinkler parts on 0.987 acres of land in the C-G zoning district. The site is located at 1565 S Rolling Hills Drive. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. General Conditions of Approval 1. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Site Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in CDC 11-3A-7, 11-3A-6B and the recorded development agreement. 2. Business hours of operation shall be limited from 6 am to 11 pm per the recorded development agreement. 3. Offstreet loading space located within fifty feet (50') of residential district shall not operate between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M. per UDC 11-3C-8D. 4. Development Agreement requires cross -access be granted and constructed to the property to the west (parcel #S 1116347191) for future connectivity when said western property develops and after use on this property changes from flex space to any other allowed use noted in provision 5.1.3 of the DA, at which time the accessory outdoor Conditions Document 1 Tribal Fire Systems—CZC, DES, ALT - A-2016-0166 storage shall cease to allow for such cross -access. A new Certificate of Zoning Compliance application will be required for the change of use and construction of cross - access and a recorded copy of the cross -access agreement shall be provided to the Planning Division with the Certificate of Zoning Compliance application. 5. Site is within the floodplain. Applicant shall obtain afloodplain development permit and coordinate with the City of Meridian Floodplain Administrator for development requirements. Process Conditions of Approval 1. Per UDC 11-513-5B2, the Director (at the applicant's request) approved alternative compliance regarding the landscape buffer adjacent to Overland Road being measured from back of curb. 2. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-5C-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-5C-3C. 4. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 1I- 3B-14A. 5. The site plan prepared by TD Architecture on June 1, 2016, labeled A1.0, is approved as shown in Exhibit B, with the following comments: a. The walkway across the drive aisle shall be distinguished from the vehicular driving surface through the use of pavers, colored or scored concrete or bricks, per UDC 11-3A-19A.4. 6. The landscape plan prepared by Breckon Landscaping on June 24, 2016, labeled L 1.1, is approved as shown in Exhibit C, with the following comments: a. Required landscape buffers shall be planted with lawn/turf sod and shall not primarily include only permabark. 7. The elevations prepared by TD Architecture on April 15, 2016, labeled A4.0 and A4.1, are approved as shown in Exhibit D. 8. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 9. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 10. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 11. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 12. If the subject property is part of a final plat that has not yet recorded, the applicant shall be responsible for all plat improvements prior to release of Certificate of Occupancy for the first structure within such plat. 13. The City of Meridian requires that the owner enter into a Warranty Surety Agreement and post a Warranty Surety in the amount of 20% of the total construction cost for all completed public sewer and water infrastructure for a duration of two years. This surety amount will be verified by a line item final cost invoicing provided by the owner to the City. The surety can be posted in the form of an irrevocable letter of credit, cash deposit or bond, and must be in place prior to Certificate of Occupancy. Applicant must file an application for surety, which can be found on the Community Development Department Conditions Document 2 ^ � " Tribal Fire Systems — CZC, DES, ALT - A-2016-0166 website. Please contact Land Development Services for more information at 208-887- 2211. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. a. Applicant shall fence storage yard in compliance with UDC 11-3A-14B and approved concept plans found in AZ-14-013. Fencing detail shall be submitted with Building Division submittal. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (H-2016-0037; AZ-14-013; DA #2016-037779). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. Photometric report shall be submitted with Building Division submittal. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC I1-3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-18. a. Office shall comprise a minimum of 30% of the structure. b. Light industry and warehousing shall not comprise more than 70% of the space. ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS: The applicant requests alternative compliance to UDC 11-3B-7Cla(1). UDC 11-3B-7Cla(1) requires landscape buffers along streets with attached sidewalks to be measured from back of sidewalk. Overland Road is considered an entryway corridor with a required buffer of at least 35 feet. The applicant proposes to construct the required buffer with the minimum buffer width being measured from face of curb with such request being approved with the recorded development agreement (DA #2016-037779). The reason for the request is because the Council required an Alternative Compliance request to process the measurement from face of curb per the development agreement. In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Because the recorded development agreement allows for this Alternative Compliance request, the depth of the lot is such as to restrict development size and ACHD requires additional right-of-way dedication for the future widening of E Overland Road, the Conditions Document 3 Tribal Fire Systems — CZC, DES, ALT - A-2016-0166 Director finds strict adherence to UDC 11-3B-7C3.b and 11-313-8C is not feasible. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The applicant is proposing to plant an additional tree within the landscape buffer along E Overland Road and also increase planting density within the landscape buffer to the north, adjacent to the residential use, as such, the Director finds the applicant's alternative means for meeting the requirements of the UDC as discussed above provides an equal or superior means of compliance. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. The Director finds that the proposed alternative will not be detrimental to the public welfare or impair the use/character of the surrounding properties. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before July 28, 2016, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-613. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance.
