DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Ken Lenz, requests Certificate of Zoning Compliance (CZC) and Design Review
(DES) approval of a restaurant with associated drive-through on 0.841 acres of land in the C -G
zoning district.
The site is located at 1535 S. Celebration Avenue.
DECISION
The applicant's request for Certificate of Zoning Compliance and Design Review is approved
with the conditions listed in this report.
Note. This is not a building permit. Please contact Building Services at (208) 887-2211 to
verify if you need a building permit and/or inspection. Ifyou do need a building permit, you
must complete that process before you commence the use or construction. Please contact
Building Services, for additional details about building permits and inspections.
General Conditions of Approval
1. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public
roadways per the City of Meridian Improvement Standards for Street Lighting. All
street lights shall be installed at developer's expense. Final design shall be submitted as
part of the development plan set for approval. Applicant shall also include the location
of any existing street lights in the development plan set. Street lighting is required at
intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in
the Standards. The contractor's work and materials shall conform to the ISPWC and the
City of Meridian Supplemental Specifications to the ISPWC.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property,
the applicant shall submit a sign permit application consistent with the standards in
UDC Chapter 3 Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health
as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other
improvements in accord with UDC 11 -5C -3C.
3. Upon installation of the landscaping and prior to inspection by Planning Division staff,
the applicant shall provide a written certificate of completion as set forth in UDC I I -
3B -14A.
4. The site plan prepared by TO Engineers on May 1, 2016, labeled C2, shown in Exhibit
B, shall be revised as follows:
a. The proposed 45 degree angled parking stalls and drive aisle design shall comply
with the standards set forth in UDC Table 11-3C-5 and Figure 1 contained in the
Conditions Document I Sonic Drive -In at Destination Place #2 - CZC, DES -.A-2016-0201
same section.
b. Revise bicycle parking facilities to meet the standards of UDC 11 -3C -5C.
c. The walkway from the perimeter sidewalk along S. Celebration Ave. to the
main building entrance is required to be distinguished from the vehicular
driving surfaces through the use of pavers, colored or scored concrete, or
bricks as set forth in UDC 11 -3A -19A.4.
d. No portion of canopy structure shall be within the PUDI easement adjacent
to E Cinema Dr and S Celebration Ave (instrument no. 105148683).
The landscape plan prepared by South Landscape Architecture on May 24, 2016,
labeled L-1, as shown in Exhibit C, shall be revised as follows:
a. Eastern most tree within the City of Meridian water main easement on the
south of the property shall be relocated elsewhere onsite to meet
requirements of City Engineer: "Trees may be planted in the portion of the
easement that extends past a line 10 feet to the west of the water meters."
6. All existing landscaping within the street buffers adjacent to E. Cinema Drive and S.
Celebration Avenue shall be protected during construction as set forth in UDC 11-313-
lOC.
7. The elevations prepared by Wilkus Architects on May 27, 2016, labeled A3.01 and
A3.02, are approved as shown in Exhibit D.
8. The approved site plan, landscape plan and/or elevations may not be altered without
prior written approval of the City of Meridian Planning Division.
9. The applicant shall pay any applicable impact fees prior to the issuance of a building
permit.
10. If any changes must be made to the site plan to accommodate ACHD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Division for
approval prior to issuance of the building permit.
11. The applicant shall complete all required improvements prior to issuance of a Certificate
of Occupancy. It is unlawful to use or occupy any building or structure until the
Building Official has issued a Certificate of Occupancy.
12. Prior to Certificate of Occupancy, the applicant shall record a cross-access/ingress-
egress easement to the property to the west (Parcel #R1814740031) and submit
copy of said easement to the Planning Division in accord with the provisions of
UDC 11 -3A -3A2.
13. The City of Meridian requires that the owner enter into a Warranty Surety Agreement
and post a Warranty Surety in the amount of 20% of the total construction cost for all
completed public sewer and water infrastructure for a duration of two years. This surety
amount will be verified by a line item final cost invoicing provided by the owner to the
City. The surety can be posted in the form of an irrevocable letter of credit, cash deposit
or bond, and must be in place prior to Certificate of Occupancy. Applicant must file an
application for surety, which can be found on the Community Development Department
website. Please contact Land Development Services for more information at 208-887-
2211.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation
that meets the standards as set forth in UDC 11-313-6 and to install and maintain all
landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as set
forth in UDC 11-3A-14.
3. The project is subject to all current City of Meridian ordinances and previous conditions
of approval associated with this site (H-2016-0045; AZ Ord. #724; PP -04-042; FP -05 -
Conditions Document 2 Sonic Drive -In at Destination Place #2 - CZC,. DES -A-2016-0201
014; SBP -08-001).
4. The issuance of this CZC does not release the applicant from any previous requirements
of the other permits issued for the site.
5. The applicant and/or property owner shall have an ongoing obligation to prune all trees
to a minimum height of six feet above the ground or sidewalk surface to afford greater
visibility of the area.
6. The applicant shall have an ongoing obligation to maintain all pathways.
7. The applicant has a continuing obligation to comply with the outdoor lighting provisions
as set forth in UDC 11-3A-11.
8. The applicant and/or property owner shall have an ongoing obligation to maintain all
landscaping and constructed features within the clear vision triangle consistent with the
standards in UDC 11-3A-3.
9. The applicant and/or assigns shall have the continuing obligation to meet the specific
use standards for the proposed use as set forth in UDC 11-4-3-11.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division on or
before July 5, 2016, within fifteen (15) days after the written decision is issued, and contain the
information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the
use has not commenced within one year of the date of issuance of the Certificate of Zoning
Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a
structure shall expire if the construction or alteration has not commenced within one year of the
date of issuance of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
June 20, 2017.

This Sonic will be located at 1535 S. Celebration Ave in Meridian. The lot is 0.84 acres
and was the subject of a property boundary adjustment (ROS#8511). This lot already has
street access and wet utility stubs for water and sewer. Storm drainage will be designed
to stay on site. Dry utilities are available for this property.
The site design includes a total of 28 parking stalls. Plus, this site will have 2 bike racks.
Pedestrian access will be from the existing sidewalks with direct access to the patio
dining area via a designated pathway. This project will have site directional signage and
building signage. Sonic will not have a monument sign, but will place signage on the
existing 2 pylon signs. Landscaping and trees will be added to the already existing
landscape and trees along S. Celebration Ave.
The proposed Sonic building is 2,308 sf with interior and exterior dining. There will be 5
round exterior patio tables along with tables inside. The exterior of this Sonic will have
somewhat different colors and materials than the other local Sonics. This way each Sonic
will have their own identity. The stone veneer selected for this project, Craft Orchard
Limestone — Greypearl, is made in Idaho. The exterior is will have stone, stucco, glass,
garage door, decorative fascia and awnings. This building varies in height from 16'4",
18'4" and 23'2". The overall length is approximately 85' and the width is approximately
31'. There is a pop out on the building where the drive thru window is located.

i) The Sonic Drive -In will be located with the main entrance facing S.
Celebration Ave. This site will have two (2) driveway access' and there is an
existing public sidewalk around the site. A defined walkway will be installed
connecting to the main entrance.
ii) The stone veneer selected for this project, Craft Orchard Limestone -
Greypearl, is made in Idaho. The exterior is will have stone, stucco, glass,
glass garage door, fascia and awnings.
b) Building Scale
i) This building varies in height from 16'4", 18'4" and 23'2". The overall
length is approximately 85' and the width is approximately 31'. There is a
pop out on the building where the drive thra window is located.
ii) Public sidewalk access will be from the street onto the outdoor patio and main
entrance.
iii) Architectural features include canopies, decorative fascia, stone and glass.
c) Building Form
i) This building has 3 changes in height. Each height change is 2' or greater.
The exterior walls are varied with material changes between stone and stucco.
ii) The south wall has a 12' wide by 4' deep bump out.
iii) The stone is articulated at the front of the building up the entire face. The
entire building has a stone apron up 3' from the sidewalk
iv) The entire dining area has an exposed ceiling over 12' in height. The dining
area is air conditioned and also has a garage door that can be opened when
weather permits.
d) Architectural Elements
i) A canopy is employed over the outdoor patio. There is an architectural
element above the bump out area on the south side.
ii) The entrance to the building has stone features that ascend the entire height of
the building.
iii) The parapet on the building will screen the mechanical units and makeup air
for mechanical units in the kitchen area.
iv) The trash enclosure and transformer will be located at the rear of the building
out of view from public access.
e) Materials
i) This Sonic, as you can see from the colored elevation, is different than any
other Sonic exterior in the market.
ii) These colors and textures are in the enclosed color palette
f) Signs & Lighting
i) This site will not have a pylon or monument sign. Sonic will be allowed on
the existing pylon signs that serve the subdivision.
ii) Sonic will have building and directional signage.
iii) The building will have "dark sky" lighting fixtures on the exterior. The site
circulation and parking will have parking lot lights that match what has been
used on the neighboring lots.
2) Parking Lot
a) Sonic has 19 stalls for customers to order and dine in their cars under a metal
canopy.
b) They also have 7 parking stalls and 2 handicap stalls on site for additional parking
3) Pedestrian Walkways and Facilities
a) The property already exists has a public sidewalk and 10 existing trees. We will
be adding approximately 8 more trees and additional landscaping.
b) The public access from the sidewalk will be across the access drive. This section
of public access will have a change in material and also be stripped for definition.
c) The public will have interior and exterior dining options.

I have reviewed the information related to the site described below. It is importantthat we do not allow the planting of
trees over the city's water and sewer infrastructure. However, in this instance the easement appears to extend well past
the city's infrastructure. Trees may be planted in the portion of the easement that extends past a line 10 feet to the
west of the water meters without an adverse effect on our ability to operate and maintain our infrastructure.

Warren,
I'm working on a project located at 1535 S Celebration Ave. It is a Sonic Drive -In. The south boundary of the project has a
City water main easement in which the applicants show tree plantings. The trees are required in the buffer for the drive
aisle area, but the UDC states that trees shall be planted outside of any easement that contains a city water or sewer
main, unless written permission is obtained from the City Engineer. This property recently underwent a property
boundary adjustment to move their property line further west, so it is unclearjust how far into the property the water
main actually extends.
I wanted to see if you are comfortable providing written permission to allow the trees within this easement or if we
should look at different alternative compliance options for this property? I have attached the plans showing locations
and the easements for reference. Let me know if you have any questions.
