This agreement entered into this 27th day of September, 1976, by
and between Joint School District No. 2, Ada County, Idaho, here after
called "School District" and the City of Meridian, Idaho Municipal corpora-
tion, hereafter called "city".
WITNESSETH
It is mutually agreed between School District and City as follows:
1. Purpose of Contract
It is the mutual best interestes of School District and City to
jointly develop outdoor recreational facilities for general public
outdoor recreation use on the following described real estate owned
by (City) School District, to wit:
LEGAL DESCRIPTION OF SITE
Part of the Southeast 4 of the Northeast 4 of Section 11, Township 3 North,
Range 1 }Vest, Boise Meridian, in Ada County, Idaho, described as follows:
Beginning at a point on the section line which bears North O009,
East, 125.00 feet from the quarter section corner common to Section
11 and .12, Township 3 North, Range 1 West, Boise Meridian, true point
of beginning; Thence West along line parallel to the mid-section line
of said Section 11, 205.43 feet to a point; thence North along a line
parallel to the Easterly boundary line of said Section 11, 272.60 feet
to a point; thence East along a line parallel to the Northerly bound-
ary line of the SE -4 NEI of said Section 11, 205.43 feet to a point
on the section line common to said Sections 11 and 12; thence South
along the section line to the POINT OF BEGINNING.
2. Immediate Improvement; Effective Date; Financin
a. The School District shall, within a twelve (12) month period of
time, and at its own expense without assistance from the City,
cause to be constructed on the property described above, six
tennis courts and one comfort station.
b. Joint operation and use of the facilities shall commence upon
completion of improvements provided for herein.
3. Future Use
The primary purpose of the facilities shall be for outdoor recreation
by the general public. The School District agrees that all outdoor
recreation facilities on the site including those on adjacent school
lands shall be opened and available for general public use when not
being used for regularly scheduled school activities, as outlined on
the attached schedule of use.
4. Future Maintenance
The School District agrees to operate and maintain the facilities
during the school year (September 1 - May 31) and the City agrees to
operate and maintain the facilities during the summer months (June 1 -
August 31). The comfort station restroom facilities are the primary
maintenance and operation responsibilities that will be shared.
5. Term of Agreement
This agreement shall be in effect perpetually and may otherwise be
terminated by mutual agreement of the parties. Both parties agree
in the event of termination to comply with the terms and conditions
of the agreement between the parties and the State of Idaho, the
Administrator of the Land and Water Conservation Fund Program,
subject to such compliance, both parties covenant that the entire
property subject to this agreement shall continue to be operated and
maintained for public outdoor recreation.
6. Ownership of Property - (School - City)
The property as described in section 1 of this agreement is
owned entirely by the School District.
7. Binding Effect
This agreement is not only binding upon the parties hereto but upon
their respective successors in the event of changing in form or
consolidation of City or School District. This agreement may not
be assigned by either party without written consent of the other.
8. Approvals
Each party certified that this Agreement has been duly and legally
approved for signature by the parties in accordance with legal
requirements.

Dear Mayor Storey:
The Idaho Department of Parks and Recreation recently awarded the
school district a grant to construct six tennis courts and a required
restroom facility. This recreational development and the support
facilities will be located at the Senior High School, South of the
entrance street that fronts on Linder Road. Users of these tennis courts
will park vehicles in the school parking lot that adjoins the develop-
ment.
As previously agreed to, the completed project will be maintained
and operated jointly by the city and the school,district; and made
available to all the public as a park and recreation facility.
The purpose of this letter is to enlist the city's assistance in
providing water and sewer service to the restroom facility that will be
a part of this recreational development. A main water line is on Linder
Road and within a year or so, a main sewer line will also be there.
Is it permissible to have the water service to this restroom faci-
lity hooked up directly to city water without the cost of installing a
separate water meter? Could this facility be dry -lined so that when
sewer is available, it is hooked up directly to the main sewer line,
rather than going through the Senior High service lines? It might be
noted that we have received permission to keep these restrooms locked
up until city sewer is available.
The architect is.working on the plans for this project and an
early decision will be most helpful.

1. Delete gate and concrete slab shown on Sheet Al located at grid 4
and grid D intersection. In lieu of above, install a standard
2'-6" x 7' swinging gate with necessary post and hardware.

Tennis Court Acrylic Surfacing System
1. All materials shall be delivered to the construction site in its
original form; unopened containers clearly labeled with trade name
and name of the manufacturer.
2. All court lines shall be of "Laykold Paint" or "Hi -Hide" plexicolor
line paint located and marked in accordance with rules of the United
States Lawn Tennis Association.
3. The final finish coat of Plexichrome or Laykold colorcoat 100 shall
have a minimum application rate of 8 gallons of material per 1000
square feet, based on the material prior to any dilution.
4. Final surface inspection - prior to application of a color finish
system, the court surface shall be flooded with water and allowed
to drain. Any depressions thereupon holding water deeper than one -
sixteenth inch (1/16th") shall be patched and leveled in accordance
with recommendations of the manufacturer of the color finish material
specified hereinafter.

5. Guarantee - The contractor shall guarantee the color finish system
unconditional for a period of three years, against fading, cracking,
spaulding, blistering and excessive wear. During this period of
guarantee, the owner shall perform normal maintenance, repairing
tennis racket damage and cleaning.
