BY THAT CERTAIN MASTER PERPETUAL STORM WATER DRAINAGE EASEMENT RECORDED
ON JUNE 1, 2004 AS INSTRUMENT NO. 104068411, OFFICIAL RECORDS OF ADA COUNTY,
AND INCORPORATED HEREIN BY THIS REFERENCE AS IF SET FORTH IN FULL (THE
"MASTER EASEMENT"). THE MASTER EASEMENT AND THE STORM WATER DRAINAGE
SYSTEM ARE DEDICATED TO ACHD PURSUANT TO SECTION 40-2302 IDAHO CODE. THE
MASTER EASEMENT IS FOR THE OPERATION AND MAINTENANCE OF THE STORM WATER
DRAINAGE SYSTEM.
5. LOT 16, BLOCK 40 IS DESIGNATED AS A COMMON AREA LOT TO BE OWNED AND
MAINTAINED BY THE PARAMOUNT OWNER'S ASSOCIATION.
6. IN COMPLIANCE WITH THE IDAHO CODE SECTION 31-3805 THE OWNER OF THIS
SUBDIVISION HAS PROVIDED AN UNDERGROUND IRRIGATION SYSTEM. LOTS WITHIN THE
SUBDIVISION WILL BE OBLIGATED FOR ASSESSMENTS FROM SETTLER'S IRRIGATION
DISTRICT FOR SAID IRRIGATION WATER.
7. MAINTENANCE OF ANY IRRIGATION OR DRAINAGE PIPE OR DITCH CROSSING A LOT IS THE
RESPONSIBILITY OF THE LOT OWNER UNLESS SUCH RESPONSIBILITY IS ASSUMED BY AN
IRRIGATION/DRAINAGE DISTRICT.
8. THE PRESSURE IRRIGATION SYSTEM WITHIN THIS DEVELOPMENT SHALL BE OWNED &
MAINTAINED BY THE PARAMOUNT OWNER'S ASSOCIATION.
9. ANY RESUBDIVISION OF THIS PLAT SHALL BE IN COMPLIANCE WITH THE MOST RECENTLY
APPROVED SUBDIVISION STANDARDS OF THE CITY OF MERIDIAN.
10. THE BOTTOM ELEVATION OF HOUSE FOOTINGS SHALL BE SET A MINIMUM OF 12 INCHES
ABOVE THE HIGHEST KNOWN NORMAL GROUND WATER ELEVATION.
11. BUILDING SETBACKS AND DIMENSIONAL STANDARDS IN THIS SUBDIVISION SHALL BE IN
COMPLIANCE WITH CONDITIONAL USE PERMIT (CUP-03-008) WHICH ALLOWED FOR
REDUCED SETBACKS, LOT SIZES, AND LOT FRONTAGES.
12. THIS DEVELOPMENT RECOGNIZES SECTION 22-4503 OF THE IDAHO CODE, RIGHT TO FARM
ACT, WHICH STATES: "NO AGRICULTURAL OPERATION OR AN APPURTENANCE TO IT
SHALL BE OR BECOME A NUISANCE, PRIVATE OR PUBLIC, BY ANY CHANGED CONDITIONS
IN OR ABOUT THE SURROUNDING NONAGRICULTURAL ACTIVITIES AFTER THE SAME HAS
BEEN IN OPERATION FOR MORE THAN ONE (1) YEAR, WHEN THE OPERATION WAS NOT A
NUISANCE AT THE TIME THE OPERATION BEGAN; PROVIDED, THAT THE PROVISIONS OF
THIS SECTION SHALL NOT APPLY WHENEVER A NUISANCE RESULTS FROM THE IMPROPER
OR NEGLIGENT OPERATION OF ANY AGRICULTURAL OPERATION OR APPURTENANCE TO IT."
13. THE REAR SETBACKS FOR LOTS 3-6, BLOCK 50; SHALL BE A MINIMUM OF 9.00 FEET
FROM THE RIGHT-OF-WAY WHICH IS ALSO 20.00 FEET FROM THE EXISTING
UNDERGROUND DRAINAGE FACILITY. SAID SETBACK SHALL APPLY TO ALL BUILDING
FOUNDATIONS.
14. THIS PLAT IS SUBJECT TO A DEVELOPMENT AGREEMENT RECORDED AS INSTRUMENT NO.
103137116 OF ADA COUNTY RECORDS.
