AND THE STORM WATER DRAINAGE SYSTEM ARE DEDICATED TO ACHD PURSUANT TO SECTION
40-2302 IDAHO CODE. THE MASTER EASEMENT IS FOR THE OPERATION AND MAINTENANCE OF THE
STORM WATER DRAINAGE SYSTEM.
5. LOTS II, BLOCK 42, LOTS 13 AND 26, BLOCK 54, LOTS 10 AND 15, BLOCK 55, LOT 6, BLOCK
75, LOTS I AND 21, BLOCK 76, LOTS 10 AND 15, BLOCK 66, LOT 12, BLOCK 39 AND LOT 1, BLOCK
58; IS DESIGNATED AS A COMMON LOT AND SHALL BE OWNED AND MAINTAINED BY THE PARAMOUNT
OWNERS ASSOCIATION OR ASSIGNS.
6. IN COMPLIANCE WITH THE IDAHO CODE SECTION 31-3805(D(b) THE OWNER OF THIS SUBDIVISION
HAS PROVIDED AN UNDERGROUND IRRIGATION SYSTEM. LOTS WITHIN THE SUBDIVISION WILL BE
OBLIGATED FOR ASSESSMENTS FROM SETTLERS IRRIGATION DISTRICT FOR SAID IRRIGATION WATER.
7. THE PRESSURE IRRIGATION SYSTEM WITHIN THIS DEVELOPMENT SHALL BE OWNED & MAINTAINED
BY THE PARAMOUNT OWNERS ASSOCIATION.
8. ANY RESUBDIVISION OF THIS PLAT SHALL BE IN COMPLIANCE WITH THE MOST RECENTLY
APPROVED SUBDIVISION STANDARDS OF THE CITY OF MERIDIAN.
9. BUILDING SETBACKS AND DIMENSIONAL STANDARDS IN THIS SUBDIVISION SHALL BE IN COMPLIANCE
WITH THE DIMENSIONAL STANDARDS OF THE R-8 ZONING DISTRICT IN EFFECT AT THE TIME OF
ISSUANCE OF BUILDING PERMITS.
10. THE BOTTOM ELEVATION OF HOUSE FOOTINGS SHALL BE SET A MINIMUM OF 12 INCHES ABOVE
THE HIGHEST KNOWN NORMAL GROUND WATER ELEVATION.
II. THIS DEVELOPMENT RECOGNIZES SECTION 22-4503 OF THE IDAHO CODE, RIGHT TO FARM ACT,
WHICH STATES: "NO AGRICULTURAL OPERATION, AGRICULTURAL FACILITY OR EXPANSION THEREOF
SHALL BE OR BECOME A NUISANCE, PRIVATE OR PUBLIC, BY ANY CHANGED CONDITIONS IN OR ABOUT
THE SURROUNDING NONAGRICULTURAL ACTIVITIES AFTER IT HAS BEEN IN OPERATION FOR MORE THAN
ONE (D YEAR, WHEN THE OPERATION, FACILITY OR EXPANSION WAS NOT A NUISANCE AT THE TIME IT
BEGAN OR WAS CONSTRUCTED. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY WHEN A
NUISANCE RESULTS FROM THE IMPROPER OR NEGLIGENT OPERATION OF AN AGRICULTURAL
OPERATION, AGRICULTURAL FACILITY OR EXPANSION THEREOF."
12. THE LOTS, INCLUDING BUILDING AND OCCUPANCY, ARE SUBJECT TO THE TERMS AND CONDITIONS
OF THAT CERTAIN MASTER DECLARATION, AS AMENDED FROM TIME TO TIME, OF COVENANTS,
CONDITIONS, RESTRICTIONS AND EASEMENTS FOR PARAMOUNT SUBDIVISION FILED AS INSTRUMENT NO.
104047957, OFFICIAL RECORDS OF ADA COUNTY, IDAHO.
13. THIS SUBDIVISION IS SUBJECT TO A LICENSE AGREEMENT WITH ACHD FOR LANDSCAPING AS
RECORDED IN INSTRUMENT NO, 2015-095080, OFFICIAL RECORDS OF ADA COUNTY, IDAHO.
LANDSCAPING SHALL BE OWNED AND MAINTAINED BY THE PARAMOUNT OWNERS ASSOCIATION OR
ASSIGNS.
14. LOT 18 OF BLOCK 54, LOTS 9 AND 16 OF BLOCK 76 ARE DESIGNATED AS COMMON DRIVEWAYS
TO PROVIDE ACCESS TO LOTS 15, 16, 17 AND 19 OF BLOCK 54, LOTS 6, 7, 8, 10, 15, 17, 18 AND 19
OF BLOCK 76, RESPECTIVELY, SAID LOT 18 OF BLOCK 54, LOTS 9 AND 16 OF BLOCK 76 ARE TO BE
OWNED BY THE PARAMOUNT OWNERS ASSOCIATION INC., OR ASSIGNS, AND THE OWNERS OF THE
LOTS WHICH WILL BENEFIT FROM USE OF THE COMMON DRIVEWAY SHALL MAINTAIN, REPAIR AND 0
OR REPLACE AT THEIR OWN COST AND EXPENSE SAID DRIVEWAY. LOT 18 OF BLOCK 54 AND LOTS 9
