NOTES:
1) ALL _LOTS ARE HEREBY DESIGNATED -AS HAVING A PERMANENT EASEMENT FOR PUBLIC

2) ALL LOTS ARE HEREBY DESIGNATED AS HAVING A PERMANENT EASEMENT FOR PUBLIC
UTILITIES, NAMPA & MERIDIAN IRRIGATION DISTRICT IRRIGATION AND LOT DRAINAGE OVER THE
TEN (10) FEET ADJACENT TO ANY REAR LOT LINE AND OVER THE FIVE (5) FEET ADJACENT TO

3) DEVELOPMENT OF THIS SUBDIVISION SHALL CONFORM TO THE APPLICABLE ZONING
REGULATIONS OF THE CITY OF MERIDIAN IN EFFECT AT THE TIME OF ISSUANCE OF A
BUILDING PERMIT.
4) ANY RESUBDIVISION OF THIS PLAT SHALL COMPLY WITH THE APPLICABLE ZONING
REGULATIONS IN EFFECT AT THE TIME OF RESUBDIVISION.
5) MINIMUM BUILDING SETBACK LINES SHALL BE IN ACCORDANCE WITH THE ZONING ORDINANCE
AT THE TIME OF ISSUANCE OF ANY BUILDING PERMIT. ALL LOT, PARCEL AND TRACT SIZES SHALL
MEET DIMENSIONAL STANDARDS ESTABLISHED IN THE ZONING ORDINANCE.
6) THE BOTTOM ELEVATION OF STRUCTURAL FOOTINGS SHALL BE SET A MINIMUM OF 12 INCHES
ABOVE THE HIGHEST KNOWN NORMAL GROUND WATER ELEVATION.
7)_- THIS SUBDIVISION IS SUBJECT TO COMPLIANCE WITH THE IDAHO CODE SEC11ON 31-3805
CONCERNING IRRIGATION WATER. THE OWNER HAS COMPLIED WITH IDAHO CODE SECTION
31-3805(1)(b)(i). IRRIGATION WATER IS PROVIDED BY THE NAMPA MERIDIAN IRRIGATION DISTRICT
PER AGREEMENT RECORDED AS INSTRUMENT NO. 2014-063427, RECORDS OF ADA COUNTY,

IS THE RESPONSIBILITY OF THE LOT OWNER UNLESS SUCH RESPONSIBILITY IS ASSUMED BY AN
IRRIGATION/DRAINAGE DISTRICT.
9) THIS DEVELOPMENT RECOGNIZES IDAHO CODE SECTION 22-4503, RIGHT TO FARM ACT, WHICH
STATES: NO AGRICULTURAL OPERATION, AGRICULTURAL FACILITY OR EXPANSION THEREOF SHALL
BE OR BECOME A NUISANCE, PRIVATE OR PUBLIC, BY ANY CHANGED CONDITIONS IN OR ABOUT
THE SURROUNDING NONAGRICULTURAL ACTIVITIES AFTER IT HAS BEEN IN OPERATION FOR MORE
THAN ONE (1) YEAR, WHEN THE OPERATION, FACILITY OR EXPANSION WAS NOT A NUISANCE AT
THE TIME IT BEGAN OR WAS CONSTRUCTED. THE PROVISIONS OF THIS SECTION SHALL NOT
APPLY WHEN A NUISANCE RESULTS FROM THE IMPROPER OR NEGLIGENT OPERATION OF ANY
AGRICULTURAL OPERATION, AGRICULTURAL FACILITY OR EXPANSION THEROF".
