Notes:
1) A twelve (12) foot wide Permanent Public Utilities, Property Drainage, and
Irrigation Easement is hereby designated along all lot lines common to a Public
Right —of —Way and along all rear lot lines. A five (5) foot wide Irrigation, Public
Utilities and Property Drainage Easement is hereby designated along each side of
interior lot lines.
2) Any Re —Subdivision of this Plot sholl be in compliance with the most recently
approved Subdivision Standards of the City of Meridian.

4) This development recognizes Idaho Code Section 22-4503, Right to Form Act,

surrounding Nonagricultural Activities after the same has been in operation for
more than One (1) year, when the Operation was not a nuisance at the time the
Operation began; Provided that the Provisions of this Section shall not apply
whenever a nuisance results from the improper or negligent Operation of any
Agricultural Operation or Appurtenance to it."
5) Maintenance of any irrigation or drainage pipe or ditch crossing a lot is the
responsibility of the lot owner unless such responsibility is assumed by an
Irrigation/Drainage District. Irrigation water provided by the Nompa Meridian
Irrigation District in compliance with Idaho Code Section 31-3805(b). Lots within
this subdivision will be entitled to irrigation water rights, and will be obligated for
assessments from the Nompa Meridian Irrigation District.
6) The bottom elevation of all structural footings sholl be set a minimum of
12—inches above the highest established normal Ground Water Elevation.
7) Portions of Lots 39 and 40, Block 1, and Lot 14, Block 11, have an ACHD
sidewalk easement as shown Instrument No 107092347,
8) All front garage setbacks shall be 20 feet as measured from the property line or
the back of sidewalk, whichever is more restrictive.
9) This plot is subject to a development agreement recorded as Instrument Number
105134292 of Ada County Records.
10) A portion of Lot 40, Block 1 has a 20' wide City of Meridian Sanitary Sewer
