CZCCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: June 15, 2016 TO: Steven Adamson FROM: C.Jay Coles, Assistant City Planner SUBJECT: Dutch Bros. #5 - CZC, DES - A-2016-0202 OWNER: GGR, LLC DESCRIPTION OF APPLICANT'S REQUEST DAHO The applicant, Steven Adamson, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a coffee shop/restaurant with associated drive -through on 0.537 acres of land in the C-G zoning district. The site is located at 37 E. Calderwood Drive. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-22II to verify ifyou need a building permit and/or inspection. Ifyou do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. General Conditions of Approval 1. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Site Conditions of Approval 1, Business hours of operation shall be limited from 5am to I Ipm per CUP H-2016-0025. 2. All existing landscaping within the street buffer adjacent to S Meridian Road (SH-69) shall be protected during construction in accord with UDC 11-3B-1OC. 3. A cross-access/shared-parking easement/agreement is required to be recorded for the commercial development per DA #2015-043235. A copy of the recorded agreement is required to be submitted to the Planning Division prior to the issuance of the certificate of occupancy. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health Conditions Document I Dutch Bros. #5 - CZC, DES - A-2016-0202 asset forth in UDC 11-5C-3B. A surety agreement maybe accepted for other improvements in accord with UDC 11-5C-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC I I - 3B-14A. 4. The site plan prepared by Houston Bugatsch Architects on May 4, 2016, labeled S 1.0, shall be revised as follows: a. Widen the internal sidewalk that abuts the parking stalls to 7 feet to allow for 2 feet of vehicle overhang; or, widen the sidewalk to a minimum of 5 feet and provide wheel stops within the parking stalls to prevent vehicle overhang in accord with UDC 11-3A-17 and 11-3C-5B4. b. Parking stall dimensions shall be shown on site plan. c. Per CUP H-2016-0025, stripe the stacking lane for the drive -through leaving a 25-foot wide drive aisle for vehicles entering and exiting the parking stalls to meet requirements of UDC 11-4-3-11 C2. Stacking lane can we reduced to 12 feet in width. d. Include bicycle rack location on site plan and submit detail of proposed rack(s) for review. e. Edge of landscape buffer on the south of the site and adjacent to the 25' access drive shall be curbed. 5. The landscape plan prepared by Houston Bugatsch Architects on May 25, 2016, labeled L1.0, shall be revised as follows: a. One additional tree shall be planted within the landscape buffer adjacent to S Meridian Road to meet density requirement per UDC 11-3B-7C3b. b. One additional tree shall be planted within the landscape buffer adjacent to E Calderwood Drive to meet density requirement per UDC 11-3B-7C3b. 6. The elevations prepared by Houston Bugatsch Architects, shall be revised as follows: a. Per CUP H-2016-0025, elevations shall substantially comply with those submitted for the CUP application. Coil overhead door on the east elevation shall be removed and replaced with the fenestration shown on the approved CUP elevations. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. Requested revisions shall be submitted with the Building Division submittal. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. The City of Meridian requires that the owner enter into a Warranty Surety Agreement and post a Warranty Surety in the amount of 20% of the total construction cost for all completed public sewer and water infrastructure for a duration of two years. This surety amount will be verified by a line item final cost invoicing provided by the owner to the City. The surety can be posted in the form of an irrevocable letter of credit, cash deposit or bond, and must be in place prior to Certificate of Occupancy. Applicant must file an application for surety, which can be found on the Community Development Department website. Please contact Land Development Services for more information at 208-887- Conditions Document 2 Dutch Bros. #5 - CZC, DES - A-2016-0202 2211. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (H-2016-0025; DA 42015-043235; RZ-15-002; VAC-15-002). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. a. Photometric report specific to the site shall be submitted with the Building Division submittal. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-11. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before June 30, 2016, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-613. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Caldwerwood Drive Design Review, and Certificate of Zoning Compliance On behalf of the owners, we hereby apply for Design Review and CZC for the Dutch Bros Coffee Stand #5 located at 37 E. Calderwood Drive. This will be a new building located in the C-G zone. In 2015, the subject property was rezoned (RZ-15-002) with the requirement of a Development Agreement (#2015-043235); and a conditional use permit modification (MCt115-001) was approved to modify the site plan and exclude the site from the Larkspur planned unit development. Approval to vacate (VAC-15- 002) a portion of a plat note on the recorded plat for Larkspur Subdivision and reduce the platted width of the Meridian Road street buffer was also approved. Access to the property is provided by two driveways, one located north of the site E. Calderwood Dr. and one located east of the site S. Blackspur Way. Internal drives will be owned and maintained by the property owners within the development. As designed, the current and future sites has excellent internal circulation and access to the public road system, which has adequate capacity to accommodate the trips generated by this development. A total of one building will be constructed on this parcel. The other lots, to my knowledge, have yet to be developed and will not be considered as part of this project. Landscaping and the amenities will be maintained by a private, off -site landscaping company. Narrative describing compliance with the guidelines contained in the Meridian Design Manual: 1. Architectural Character: a) Facades. The building fagade is consistent with the overall Dutch Bros Coffee corporate design theme but will vary in its basic design. This will be a single sided drive-thru stand, and will have the extension of the drive-thru canopy and large walk-up order canopy. The entrance is defined by the large canopy at the north side of the building. This is direct path from the vehicle/bike parking areas and the public cross walk on to the property. c) Roof Lines. The roof line of this structure is straight and flat around the perimeter of the building and interrupted in two areas by a raised peak for building signage. At the center of the building the roof will be a gabled metal roof with the Dutch Bros windmill trademark. d) Pattern Variations. The fagade portion of the building is designed so that there is material and shadow variation to the design but yet kept simple to meet the Dutch Bros standards. Stucco bands and the use of cultured stone brakes up the monotony of the traditional box drive-thru coffee stand. e) Mechanical Equipment. AC condensers will be the only mechanical equipment not contained within the building and will be located on the roof of the building. 2. Materials: Since this will be a franchise building and one of the first structures in this subdivision, there are no other buildings that this this need to contend or mimic in design. The building materials will be that of stucco, cultured stone and architectural standing seam metal roofing. Colors to be Dutch Bros blue, gray and white. 3. Parking Lots: Parking for this site will be located to the northeast of the building with a shared inlet/outlet with the other parcels. A shared access will also be available to the east part of property. The trash enclosure will be easily accessible from the parking lot and main drive-thru. 4. Pedestrian Walkways and facilities: Pedestrian walkways and drop-off zones are easily designated by parking layout and lighting design. Walkways are designed to provide efficient access to building entries and exits at all areas of the site. Also, will be provided is a 5'-0" wide concrete path leading north from the front entrance to the public sidewalk onto Calderwood Drive.
