BY: ¡j[i¡¡!rh; AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, REPEALING CHAPTER 2 TITLE 2 AND REENACTING THE PARKS AND RECREATION COMMISSION OF THE MERIDIAN CITY CODE; PROVIDING FOR CONFLICT, VALIDITY, SAVINGS CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: SECTION 1: That Chapter 2 Title 2 Parks and Recreation Commission of the Meridian City Code, be, and the same is hereby repealed. SECTION 2: That Chapter 2 Title 2 Parks and Recreation Commission of the Meridian City Code, be, and the same is hereby reenacted to read as follows: 2-2-1: Establishment, Membership, Terms, Vacancies: A. Commission Established: There is hereby established a Meridian Parks and Recreation Commission of the City. B. Membership; Compensation: 1. This Parks and Recreation Commission shall consist of a minimum of five (5) members and not more than nine (9) members.~ ".YflO shall reeeiyø Rf) salary. The Citv shall provide the necessarv and suitable equipment and supplies to enable the Commission to properlv transact and attend to its business. Residents who reside within the Citv limits. or area of impact. and are a minimum of eighteen (18) vears of age are eligible to serve on the Parks and Recreation Commission. One (1) member shall be a resident of the area of impact but no more than two (2) members mav be appointed ITom residents of the Citv impact area, outside the coroorate limits. One position mav be desÌlmated to represent vouth which Commission member mav be. at the time of appointment. under eighteen (18) vears of age. 4. One member of the Meridian City Council, the City's Parks and Recreation Director, aRà one member who represents the administration of the Joint School District No.2, Ada County, State of Idaho, and all shall serve as ex- officio members with no vote. Terms of Office: L Each Commissioner shall serve a term of three (3) years~ provided that the vouth member, or members. shall be appointed to a term of UP to one (1) vear and mav be reappointed to UP to three (3) successive terms. Commissioners wishing to serve additional terms must submit a letter of interest thirty (30) days prior to the first term expiring. The location of the applicant's residence, in order to provide a Page 2 of6 representation based upon geographic areas and population will be given strong consideration. 2-2-2: Organization; Rules and Regulations: A. Rules And Bylaws: The Parks and Recreation Commission shall adopt bylaws, rules and regulations for the proper conduct of the business of the Parks and Recreation Commission. The bylaws, rules and regulations are subject to the approval of the Mayor and City Council after recommendation by the Commission. All rules and regulations of the Parks and Recreation Commission now in effect shall remain in full force and effect until amended. altered or repealed. C. Advisory Status: The Parks and Recreation Commission shall be deemed advisory and report to the Parks and Reei"eatieR Direeter, Mayor and City Council. The Parks and Recreation Commission chairman will submit an annual report to the Mavor and Council. (Ord. 822,4-20-1999) 2-2-:1: Fees: The Parks and Recreation Commission is herebv authorized to make recommendations regarding the establishment of all fees for facilitv reservations and/or rental. facilitv admission, program activitv participation, and league registration: and the establishment of fees for urban forestry services. All rules and regulations pertaining to fees shall be subject to approval bv the Mavor and the Meridian City Council. (Ord. 4895, 12-30-85: Ord. 5227.4-17-90). 2-2-4~: Meetings: The Commission shall meet regularly each month at a time and place determined by the Commission. The regular monthlv meeting shall be held at 7:00 p.m.. on the second Wednesdav of each month unless, at the first meeting of each calendar vear. the Commission shall establish a meeting schedule for the calendar vear in which event the published schedule shall applv. All meetings shall be open to the public and shall be publicized; the Commission shall allow and promote public participation in the meetings of the Commission. The Commission shall also review and comment on any needed changes to the City's Comprehensive Plan as it relates to Parks and Recreation. Additional meetings of Commission mav be scheduled bv the Commission as necessarY to carrv out the business ofthe Commission. (Ord. 822,4-20-1999) SECTION 3: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 4: VALIDITY: The Meridian City Council hereby declares that any section, paragraph, sentence or word of this Ordinance as adopted and amended herein be declared for any reason to be invalid it is the intent of the Meridian City Council that it would have passed all other portions of this Ordinance independent of the elimination hereITom of any portion as may be declared invalid. SECTION 5: SAVINGS CLAUSE: This Ordinance does not affect an action or proceeding commenced or right accrued before this Ordinance takes effect.
