Please accept an application from Blue Marlin Investments (WH Moore Company) to
modify the following development agreements. Specific modifications are discussed
further in the text.
• Development agreement instrument No. 105048793 recorded on April 21, 2005
• Development agreement instrument No. 114002255 recorded on January 9,2014
The modifications to the development agreements will allow us to proceed to a conditional
use application for a self -storage facility to be located in the northwest section of
CemerPoint Sub #2. Please refer to Exhibit A for location within the sub and Exhibit B
for facility site plan. As shown, the facility will border Champion Park Subdivision to the
west, Jasmine Lane to the north, the future CentrePoint Way to the east and the existing
retail development to the south.
The proposed self -storage facility's perimeter walls will be 10 feet high and constructed of
a stucco material. Plans call for one entrance to the facility off of CentrePoint Way.
Please refer to exhibit C that shows the entrance design and also the wall construction that
will surround the entire project.
Enclosed storage garages will be along the interior of all perimeter walls and
approximately half of the interior space. The balance is planned as open storage.
Although not related to this application the WH Moore Company is moving forward with
extending CentrePoint Way to the north property line and recording the final plat for
CentrePoint Sub # 2.
Requested modifications to the development agreements are as follows:

Open storage as a permitted use
The existing development agreement does not permit "storage facility, outside".
When we began development of CentrePoint Market Place one tenet was to maintain high
design standards. We envisioned outside storage as what you might see in Exhibit D and it
goes without saying this would not conform to the center's design standards. However,
Mr. Moore was impressed with the quality of the proposed storage facility's architectural
design, unusual in typical self -storage facilities, and equally important the 10-foot
perimeter walls which would shield the open storage from surrounding residents and
traffic along the fixture CentrePoint Way.
Zero lot line along the north property line.
The existing development agreement calls for a 25-foot buffer with a berm and 6-foot
solid fence for commercial development that abuts Jasmine Lane.
Certainly with a retailer that creates traffic, noise, lighting etc. this type of buffer maybe
necessary. However, a self -storage facility is one of the lest intrusive uses that could
border residential. Further the self -storage facility will have a 10-foot-high solid wall
around the entire perimeter, which would include along Jasmine Lane. We would suggest
that this solid wall is equal or superior to the existing buffer requirements. The applicant
can utilize additional buildable area yet still provide an excellent buffer to the residents of
Jasmine Lane.
Fence off the Micro Path directly west of the storage facility
During previous neighborhood meetings residents of Champion Park Sub expressed
concerns about keeping the micro path open due to security concerns. As a result, a
condition was added to the development agreement that "the applicant shall fence off the
Champion Park micro path from the future multi -family development unless it is the desire
of the Champion Park neighborhood that the micro path remain open".
We recognize there is a reference to multi -family but the question is what is the purpose of
the path and with self -storage why would residents use it. We believe that it is in the best
interests of both Champion Park residents and CentrePoint Market Place to close off this
entrance.

Allow the applicant to submit for a building permit prior to plat recordation
As we previously mentioned, Mr. Moore is moving forward with construction of
CentrePoint Way and recording the final plat. However, the developer for the self -storage
facility may want to commence construction prior to plat recordation.
This request will not circumvent the normal approval process as all parties understand a
CofO would not be issued until all improvements, including CentrePoint Way have been
constructed and approved by Meridian and ACHD. This option would only allow the
applicant to dictate their construction schedule.
On a related issue we conducted the required neighborhood meeting. One couple attended
and I received two calls from residents along Jasmine Lane. All were in support of the
project as they found it the lest intrusive use within a commercial development.

in front of Meridian City Council.

discuss our request to the City of Meridian for a development agreement modification and
conditional use permit that will allow us to construct a self -storage facility on property

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-5A-5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
