SUNNYBROOK FARMS HOMEOWNERS ASSOCIATION, an Idaho
Corporation, Grantor, hereby conveys, grants and warrants to the CITY OF
MERIDIAN, a Idaho Municipal Corporation, Grantee, whose address is 33 East
Idaho Street, Meridian, Idaho 83642, for the sum of TEN DOLLARS and other good
and valuable consideration, the following described real property, ro-wit:
Lot 1 of Block 14 of Sunnybrook Farms No. 4 Subdivision,
Meridian, Idaho
SUB)ECT TO taxes and assessments for the year 2000 and
all subsequent years, together with any and all existing
easements, rights-of-way, reservations, restrictions and
encumbrances of record, to any existing tenancies, and to
all zoning laws and ordinances.
This conveyance shall include any and all appurtenances, tenements,
hereditaments, reversions, remainders, easements, rights-of-way and water rights in
anywise appertaining to the property herein described.
The Sunnybrook Farms Homeowners Association, Grantor, covenants to
the Grantee, City of Meridian, that Sunnybrook Farms Homeowners Association, the
owner in fee simple of said premises; that the premises are free from all encumbrances,
excepting those as may be herein set forth, and excepting those of record, and that
Sunnybrook Farms Homeowners Association, Grantor will warrant and defend the
same from all lawful claims.
Grantor covenants and agrees that Grantee, its successors and assigns are
released from the requirement to pay Homeowner's Association dues or assessments,
and the property is released from Grantor's Declaration of Covenants, Conditions and
Restrictions, and all supplements and modifications thereof.
