Dear Bill:
Please accept our Conditional Use Permit application and this letter of explanation of our design intent
for the proposed new retail shell located in the Chinden & Linder Crossing Development.
Site Features and Context.
The site for this project is located on one of the inner parcels of the Chinden & Linder Crossing
Development. The south side of this parcel faces Chinden which is a major arterial for traffic. A fast-food
restaurant is located to the west of our project and the parcels to the east are yet to be developed.
There is a new street and landscape buffer to the north between our project and a residential area.
Our project has a drive-thru that wraps around the building for the restaurant that will occupy the east
tenant space. Pedestrian access has been provided from Chinden that connects to the sidewalks and
patio space that is around the building. Bike spaces have been located on the east side of the building.
The parking lot has been broken up with landscape islands and lighting will match the Chinden & Linder
Crossing Development standards. Additional landscape beds have been provided around the building
and as buffers around the perimeter of the site.
Building Materials and Heights.
This retail shell is planned to house a restaurant and one or two other retail tenants. To break up the
building we used a combination of different materials and finishes, parapet heights, reveals, and
architectural features. The parapets of the building vary between 20'-8" to 25'-0" above the floor level.
To break up the walls and create a pedestrian scale we have added metal awnings and wood trellis
structures around the building. Other materials include stucco/EIFS, stone veneer, and thin brick. All
metal on the building (awnings, parapet caps, storefront windows, ect.) will be a dark grey color. The
rest of the colors are in earthtones of cream, browns, greys, and darker reds. Signage will be located on
the upper wall facing Chinden and over the entrances of each tenant space. Lighting fixtures will be
placed around the building at a level that will keep pedestrian areas well lit as well as a illuminate the
architectural features of the building.
Alternate Site Plan and Parcel Size.
The owners are in negotiations with a restaurant chain who may want the building to be a stand-alone
tenant. They will have a final decision on this before the project goes through design review. We have
provided an alternate site plan with a smaller parcel size for your review. Building and drive-thru layout
will stay the same for both conditions for the Conditional Use Permit application review.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-5A-5.
