Deed of Gift Taylor, Tim and Bass, Robert R. and Groves, R. Craig and Johnson, Gregory B. and City of MeridianDEED OF GIFT THIS DEED OF GIFT is made this day ofdeCenAt , 2002, between Tim Taylor, as a Ten percent (10%) undivided interest, Robert R. Bass, as a Twenty-two and one-half percent (22.5%) undivided interest, R. Craig Groves, as a Twenty-two and one-half percent (22.5%) undivided interest, Gregory B. Johnson, as a Forty-five percent (45%). undivided interest (collectively "Grantor") and City of Meridian, whose current address is 33 E Idaho, Meridian, Idaho 83642 ("Grantee"). WITNESSETH: Section 1. Conveyance. AS A GIFT to Grantee, Grantor does hereby grant and convey to Grantee all of the real property located in County of Ada, State of Idaho, described on Exhibit A, attached hereto and made a part hereof (hereafter, the "Property"), to be used as a public park. TOGETHER with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, but excluding, all water, water rights, ditch and ditch rights and water storage and water storage rights. This conveyance by Grantor to Grantee is made subject to the following: 1. All such taxes and assessments, including liens and assessments of any irrigation district for the year 2002, and before shall be paid by Grantee. 2. Easements and rights-of-way for roads, ditches, utilities and other purposes and uses, which easements and rights-of-way are of record or visible upon a physical inspection of the Property. Exceptions, reservations, terms, covenants and conditions of record: provided, however that Grantee shall not be subject to the Declaration of Covenants, Conditions and Restrictions for Bear Creek Subdivision (Phase #3) recorded May 9, 2002, as Instrument No. 102053464 in the records of Ada County, Idaho and further, Grantee shall not be a member of the Bear Creek Subdivision Homeowners' Association, nor subject to assessments thereof. 4. All maintenance of the Property shall be undertaken by the Grantee, and Grantee shall maintain the Property and all fixtures and equipment in satisfactory park -like condition. Section 2. Acceptance. By its acceptance below, Grantee shall be deemed to have accepted and agreed to comply with the conditions and restrictions set forth in this Deed of Gift.
