RE: Request for Alternative Compliance Pope' Garden Subdivision
Dear Sonya
After our recent meeting to discuss the Pope's Garden Subdivision and associated applications, it
was determined that I should submit an Alternative Compliance Application. This application
would include a narrative that details how the common open space in this neighborhood is
defined, as well as how it is to be used.
Pope's Garden is a multi -family development. All the areas on the outside of the buildings are
defined as common open space, for the use of all of the residents within the neighborhood.
Residents can move freely between the buildings and to use the amenities. Amenities included
the basketball court, the playground equipment, and the plaza. Accessibility to the amenities is
key in creating a successful neighborhood for all residents. Individual building owners are
prevented from limiting accessibility to these areas by the CC&R's. The residents thereby have
equal access to all the common open space in the neighborhood.
In a tradition single family neighborhood common open space needs to be in a common area lot.
This neighborhood does not need that requirement to prevent property owners from limiting
access to the common areas.
The attached is open space exhibit which shows how the Pope's Garden Subdivision complies
with the city qualified open space requirements for multi -family neighborhoods.
