MOTION CARRIED: All Yea ITEM #13 REQUEST FOR TIME EXTENSION ON FILING FINAL PLAT FOR HONOR PARK SUBDIVISION NO. 3: Kingsford: Is that applicant here? Does the Council have any questions of staff? Shari did you speak to the applicant on this or Will? Stiles: Mr. Mayor and Council I did talk to Becky Bowcutt and they would like one year extension to file their final plat. This is one that has changed names several times and gone on for quite a while. I would like to know if I could make a request on the previous item. Kingsford: The applicant got up and left, what is your comment? Stiles: That they be annexed to the City of Meridian, that was the requirement for Pacific Water Works when they made a similar request. Kingsford: We have already missed on the building permit. Let's get the double hook up and then annex them. I was thinking the same thing, we missed a building permit I don't think it is inappropriate we hit them a double hook up fee for water and look at bringing them in with the rest of that. Stiles: To force an annexation? Kingsford: When those other properties over there are annexed and Mr. Van Auker has already said that he is bringing adjacent properties in. I think we ought to look at annexing the same time. But I don't think it would hurt our coffers any to hit them with a double water hook up since we missed a building permit. I understand what you are coming from n Meridian City Council November 21, 1995 Page 32 and that is a good point. Stiles: What incentive do they have to come into the City now. Morrow: I think clearly make it a requirement of when the annexation occurs over there that they are a part of that. Did we not when we authorized them to use the septic system indicate that they had to be annexed at the earliest possible minute and as soon as sewer service became available they had to hook up to sewer service. Kingsford: I am sure that is correct. Stiles: I didn't think Sherwin Williams was part of that request. Morrow: Well, it was part of the Jackson properties. If memory serves me that was part of the testimony and with respect to that area. Stiles: Okay, I thought that was just part of the Van Auker. Kingsford: Well, given some of our review of minutes it probably wouldn't hurt to double up if we don't have it. Morrow: That they be annexed. Kingsford: That as soon as sewer is available that they be annexed. Morrow: I think my preference would be to do it sooner than that because clearly the annexation will come before the sewer is totally available in terms of my recent conversations with Mr. Van Auker. So I think I would like to see that as soon as that annexation begins to take place they be part of that. That everybody understand that as soon as sewer is available they hook onto sewer and that will reaffirm what I am under the impression we have already done. Kingsford: Well let's make that in the form of a motion and send that out as part of the minutes to the applicant. Crookston: Mr. Mayor, I think that you need to deal with Honor Park No. 3 and then go back to the Jackson Food agenda item. Kingsford: There was a motion right, Walt you made that motion didn't you? Motion Carried: All Yea: ITEM #3: PUBLIC HEARING: PRELIMINARY PLAT ON I-84 BUSINESS PARK: Becky Bowcutt. Briggs Engineering, 1111 S. Orchard, was sworn by the attorney. Bowcutt: As you can see from the plat this is a 24 lot commercial subdivision. We have read through the comments of the City Engineer and we agree with them. He had a few questions which I will address. Item #6 concerning the drain pipes - we will be rerouting the drainage ditch that traverses the property and we will be piping that; Item #10 he had some questions concerning the services to lot 69 7 of block 1 and lots 15, 16 of Block 2 - we will be extending services to those lots, it's not indicated on the preliminary but we will be; Item #13 concerns fencing of lots 12-13, block 2 - the request was to provide some type of access through any fence that's put along that perimeter so that balls from the baseball diamond could be retrieved and I have talked to Mr. Hon and he's indicated he believes it's possible to put that in his protective covenants. The fences would be placed by whoever decides to purchase a lot and develop it for commercial purposes; Item #15 basically isn't a request or standard conditign, it just makes a comment concerning the potential of expanding Storey Park and getting a secondary access to the park through the subject parcel. Mr. Hon has indicated that he may consider such request. +_�, 00*11 MERIDIAN CITY COUNCIL DECEMBER 15, 1992 PAGE 6 Tolsma: Hasn't there been a ditch road that goes down along that canal for right of way or access? Bowcutt: The water -ways that traverse that property do have - there is easements for those ditches. I don't believe they are right of ways. Any relocation of any of those ditches must be approved by Nampa Meridian Irrigation District and we do have to coordinate with them as far as transferring those easements or rights of ways and making sure everything is acceptable to them. Basically we will be dealing with them. Kingsford: Item #15 that Gary has brought up I think is an excellent one. I think it would be appropriate to have additional access there so we'd like very much to work to obtain that. Bowcutt: I recommend that you talk with Mr. Hon and see if you guys can work out some type of arrangement. Any other questions? Kingsford: Thank you. Anyone else to testify? No response. I would ask that that be set aside until they meet the requirements of the City of Meridian. Clerk Niemann: I also have two that haven't paid.
