2006-498 Bear Creek Warranty DeedCITY OF MERIDIAN RESOLUTION NO. BY THE CITY COUNCIL: BIRD, DONNELL, ROUNTREE, WARDLE A RESOLUTION APPROVING WARRANTY DEEDS FROM BEAR CREEK LLC AND THE BEAR CREEK HOMEOWNERS ASSOCIATION (GRANTORS) TO THE CITY OF MERIDIAN CITY (GRANTEE) FOR LOT 29, BLOCK 15 IN THE BEAR CREEK SUBDIVISION NO. 8 FOR A PUBLIC PEDESTRIAN PATHWAY, AUTHORIZING THE CITY CLERK TO RECORD SAID DEEDS IN THE REAL PROPERTY RECORDS OF ADA COUNTY, IDAHO, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the developer of the Bear Creels Subdivision No. 8 desires to donate certain real property for a public path; and WHEREAS, representatives from the Department of Parks and Recreation of the City of Meridian have inspected the subject property and determined that the pathway as constructed is acceptable to the City; and, WHEREAS, the Lawyers Title Company has issued a lot block report on the subject property demonstrating that the property is free of liens and encumbrances. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO: Section 1. That the Warranty Deeds, copies of which are attached hereto and incorporated herein by reference, be and the same are hereby approved as to both form and content. Section 2. That the City Clerk be, and he hereby is, authorized to record said Warranty Deeds in the real property records of Ada County, Idaho for and on behalf of the City of Meridian. Section 3. That this Resolution shall be in full force and effect immediately upon its adoption and approval.
