Paramount Northeast Assisted Living CZC A-2016-0004CERTIFICATE OF ZONING COMPLIANCE C' Y L E IDIAN REPORT DATE: January 25, 2016 TO: Jonathan Wardle, Brighton Investments, LLC FROM: Sonya Watters, Associate City Planner SUBJECT: Paramount Northeast Assisted Living - CZC, DES - A-2016-0004 OWNER: Brighton Investments, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Brighton Investments, LLC, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a 56,382 square foot 73 -unit assisted living & memory care facility on 4.89 acres of land in the C -C zoning district. The site is located at 6280 N. Fox Run Way at the southeast corner of W. Chinden Blvd. and N. Fox Run Way. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify ifyou need a building permit and/or inspection. Ifyou do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. General Conditions of Approval 1. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. 2. The owner and/or operator of the facility shall secure and maintain a license from the State of Idaho Department of Health and Welfare, Facility Standards Division in accord with UDC 11-4-3-29. 3. A barrier with a minimum height of 6 feet (6'), along the perimeter of any portion of the site that is accessible to patients who suffer from Alzheimer's disease, dementia or other similar disability that may cause disorientation shall be provided. The fencing material shall meet the swimming pool fence requirements of the building code in accord with Title 10 of MCC. Site Conditions of Approval The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B. Conditions Document 1 Paramount Northeast Assisted Living - CZC, DES - A-2016-0004 2. The applicant's request for alternative compliance to UDC 11-3A-19A.3a for approval of the proposed parking layout was approved by the Director with the conditional use permit application (H-2015-0008). 3. Bicycle parking facilities shall comply with the standards listed in UDC 11 -3C -5C. 4. The design of the trash enclosure shall be compatible with the building in regard to materials and colors. 5. The walkway from the perimeter sidewalk along Fox Run Way to the main building entrance shall be distinguished from the vehicular driving surface through the use of pavers, colored or scored concrete or bricks, per UDC 11 -3A - 19A.4. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11- 313-14A. 4. The site plan prepared by Babcock Design Group on September 30, 2015, included in Exhibit B, is approved as submitted. 5. The landscape plan prepared by Baer Design Group, LLC on December 28, 2015, included in Exhibit C, is approved as submitted. 6. The elevations prepared by Babcock Design Group on September 30, 2015, included in Exhibit D, is approved as submitted. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. If the subject property is part of a final plat that has not yet recorded (i.e. Paramount Veranda Subdivision), the applicant shall be responsible for all plat improvements prior to release of Certificate of Occupancy for the first structure within such plat. 12. The City of Meridian requires that the owner enter into a Warranty Surety Agreement and post a Warranty Surety in the amount of 20% of the total construction cost for all completed public sewer and water infrastructure for a duration of two years. This surety amount will be verified by a line item final cost invoicing provided by the owner to the City. The surety can be posted in the form of an irrevocable letter of credit, cash deposit or bond, and must be in place prior to Certificate of Occupancy. Applicant must file an application for surety, which can be found on the Community Development Department website. Please contact Land Development Services for more information at 208-887- 2211. Conditions Document 2 Paramount Northeast Assisted Living - CZC, DES - A-2016-0004 Ongoing Conditions of Approval t. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The subject property adjoins a state highway; access to the state facility is restricted as set forth in UDC 11 -3H -4B. 3. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 4. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -03-006; H-2015-0008; H-2015-0022). 5. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 6. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 7. The applicant shall have an ongoing obligation to maintain all pathways. 8. The applicant has a continuing obligation to comply with the outdoor lighting provisions asset forth in UDC 11-3A-11. 9. The applicant and/or property owner shalt have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. to. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-29, Nursing or Residential Care Facilities. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before February 9, 2016, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. As a 'Nursing or Residential Care Facility' the project complies with UDC 11-4-3-29, this will be elaborated further below. This project has been approved through the CUP process by the planning and zoning commission (CUP H-2015-0008). There was no City Council Review on this project as it was approved at the P & Z Commission Meeting on December 03, 2015 as a 'Findings of fact and Conclusions of Law for Approval'. Since this building is located at the entry of a residential development, there has been great care taken to make sure the building blends well with the surrounding structures. There are low pitched roofs so that the building does not appear massive compared to surrounding areas. The exterior of the building will employ hardie panel lap siding, beadboard, and shake shingles with stone veneer accents. These type of building finishes are similar to those found on the surrounding residential structures. There is a minimum 6 feet tall fence around the proposed memory care courtyard, per UDC 11-4-3-29C. There is a gate with a knox box (per Meridian Fire Department) that will allow emergency personal to access this enclosure if needed. On the south and east sides of the project a minimum 25 feet landscape buffer has been created. This landscape buffer is planted in accordance with City of Meridian requirements. There has been additional landscape areas provided next to the building so that trees and shrubs can be planted to break up the mass of the building. All of the parking (47 stalls) has been located on the west side of the building opposite of the future residential development on the east. Locating the parking on the west side will also minimize traffic impacts on the current residential traffic. The trash enclosure has been located on the north end of the building; this is to minimize traffic impact of service vehicles on the residents in the area. Our project will also allow for residents to the south to move their loved ones closer to them as they get older. • C-1.2 Access & Connectivity o Veranda will be using an existing curb cut on the south side of the project. The road being developed off this existing curb cut will be the access for the future development to the east. o The new access on Fox Run Way will allow for minimal impact of delivery traffic on the residents to the south of the project. o Solid waste & delivery points for the building have been located on the northwest corner of the project. This is so that the noise of these services can be buffered by the landscape on the remainder of the site. o All parking is located in the front of the site; this prevents heavier impact on the residential traffic. o The bike rack is located at the main entrance, also the pedestrian sidewalk from Fox Run Way to the main entrance lies next to the bike rack. This interaction will assist in the local residents using bikes to visit family members living at the facility. • C-1.3 Orientation & Layout o Veranda's main entrance is located along Fox Run Way and the main drive entry terminates at the entrance. This ensures that people visiting will not get lost and drive into the residential area to the south. o The parking is located on the west side of the site (front) because the majority of those visiting the facility are either employees orthere for family members. o There is a large landscape area between the parking and Fox Run Way as a way to use vegetation to break-up the mass of the building; creating a soft buffer for the residents as they drive by. 1 babcock design group collaboration innovation iranstormation DESdGN THAT MAKES A DIFFERENCE • C-1.4 Parking o The required parking for this type of facility is 44 stalls with 2 of those stalls being ADA; we are providing 43 stalls with 4 ADA stalls for a total of 47 stalls. o All of the parking is located at the front of the building; this allows all traffic impact in the area to have a minimal impact on the residential area to the south. o Having all of the parking at the front will prevent visitors from parking on the nearby streets and agitating the residents in the area. o Parking lights are located towards the inside of the site to limit the impact of light bleeding into the residential areas around the site. • C-1.5 Public & Open Space o With residential areas surrounding the site, there is a minimum 25 feet landscape buffer around the site. This buffer allows for plantings to break-up the mass of the building. o There is also an internal courtyard to promote residents of the facility to venture outside. o There are multiple benches around the courtyards by the building to welcome people to sit and visit with family members residing at the facility. o The 6 foot tall fence around the memory care courtyard is of rod iron and gives a residential feel to the area. • C-1.6 Landscaping o All landscaping on the site meets or exceeds city code requirements. o There is a minimum 4 foot landscape area around the building for shrubs and trees. This allows for the building to have more of a residential look rather than a commercial look. o All landscape matches existing landscape along Fox Run Way and throughout the Paramount Development. 2.0 Architectural Character: • C-2.1 Cohesive Design o Veranda is designed to look like a residential home. There are elements of gable roofs, building extensions, and extended eaves to break up what could be a very flat elevation. This is done so that the building takes on more of a residential look. o The building materials selected are very similar to materials found in the residential homes located to the south of the site. o Colors to be used on the exterior of the building are similar to those found on the surrounding residential homes. • C-2.2 Building Scale o Great care was taken to not go with a two story structure, as this would not blend with the smaller residential homes nearby. o The main roof structures slope was flattened to help scale down the size of the building. • C-2.3 Building Form o Building articulation was done as a way to break up a long flat building. At the building articulations different building materials were used to break up the feel of the building. o Eave extensions were used to give articulation to the roof line. • C-2.4 Architectural Elements o A Porte Cohere is located at the main entry; this provides a covered area for residents to enter cars without getting wet by rain. ba b co c k design group collaboration Innovation transformation DESIGN THAT MAKES A DIF=ERENCE o There are larger structures located at the main entrance to the building to direct people to the main entrance. And allows for a larger volume space on the interior of the building. o The large gable roof at the entry is repeated along the front of the building but in smaller scale. o Non-structural roof braces are repeated around the building at the roof extensions. o Non-structural timber extension and gable trusses are used at the ends of the gable roofs to provide a shadow effect on the fagade of the building. o There are a couple different styles of shake shingles used on the gable roofs to break up the facades. o All roof mechanical units are hidden in roof wells with mansard roofs. The inside measurement is 11'4 %" before the post is set and the hinges hung leaving about 10' workable inside space so with the cab at 8' and a foot on each side for the mirror brackets it puts us very close to the gates with no room for error We prefer 12' inside but can live with what you have provided the bollards at the end of the walls are replaced with the gate post and the hinges are placed on the outside edge allowing the gates to clear all the way out of the way with corresponding peg holes at the widest point to keep them from blowing shut during storms.
