CZC Wahooz Addition A-2015-0071CERTIFICATE OF ZONING COMPLIANCE REPORT Cj E IDIAN DATE: December 4, 2015 TO: Trent Koci, BRS Architects FROM: CJay Coles; Assistant City Planner SUBJECT: Wahooz Expansion - CZC, DES - A-2015-0071 OWNER: Black Mor, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Trent Koci, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of an addition of 16,991 sq. ft. to existing 54,454 sq. ft. structure on 6.253 acres of land in the C -G zoning district. The site is located at 1385 S. Blue Marlin Lane. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify ifyou need a building permit and/or inspection. Ifyou do need a building permit, you trust complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. Site Conditions of Approval 1. Handicap parking spaces abutting the walkway shall be provided with substantial wheel restraints per UDC 11 -3C -5B3. 2. New landscape planter islands shall contain deciduous shade trees and other vegetative ground cover per UDC 11-311-8. 3. Applicant shall submit a detailed landscape plan, for all proposed new and modified landscaping, with the Building Division submittal. 4. At least six bicycle parking stalls are required for this site. Provide bicycle parking stall locations on site plan submitted with the Building Division submittal. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11- 3B -14A. 4. The site plan prepared by BRS Architects on November 19, 2015, labeled SD 1.1, is Conditions Document 1 Wahooz Expansion - CZC,. DES -A-2015-0071 approved as shown in Exhibit B. 5. The elevations prepared by BRS Architects on November 19, 2015, labeled A4.1, are approved as shown in Exhibit C. 6. The approved site plan and elevations may not be altered without prior written approval of the City of Meridian Planning Division. 7. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. Requested changes shall be submitted with the Building Division submittal. 8. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 9. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC I1 -3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CZC-06-147; CZC-09-033; CZC-11-005; DA #97044085). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the arts, entertainment or recreation facility as set forth in UDC 11-4- 3-2. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before December 21, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a Conditions Document 2 W ahooz Expansion - CZC, DES - A-2015-0071 structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Blue Marlin Lane BRS Project No. 15079 The applicants, Black Mor, LLC, respectfully request Certificate of Zoning Compliance and Design Review approval to construct a single story 16,991 s.f. addition to the existing 54,454 s.f. Wahooz Family Fun Center at 1385 S. Blue Marlin Way in Meridian, ID. As you may recall, the applicant submitted plans for review in July of 2009 with the file numbers CZC-09-033, DES -09-015 and ALT -09-022 for a 61,813 s.f. building addition that would have included a themed dining restaurant, large indoor game and amusement center and a 24 lane bowling alley. After receiving the initial approvals and completing the construction drawings, it was determined that a center of this size was not financially feasible at the time. In April of 2011, the applicant requested CZC and Design Review approval (CZC-11-005) to construct the 26,932 s.f. bowling alley phase of the project and completed the construction of the addition later that same year. The applicant has now determined that the expansion to the Family Entertainment Center (F.E.C.) is feasible, and is seeking CZC and Design Review approval for this next phase of the development. The building addition will occupy the space of the existing parking field that is south west of the existing buildings main entry and will be utilized as an expansion to the existing Wahooz Family Entertainment Center and will feature large scale attractions like bumper cars, an elevated indoor ropes course, a twister carnival type ride and a multitier jungle gym called Ballocity. There will also be areas for an electronic gaming arcade, groups of tables and seating for watching family members on the attractions and an expansion to the existing bowling cafe area. Other than providing a space for the proposed expansion in the existing parking area just south of the entry, the site will mostly remain unchanged. The existing emergency vehicle access/service lane will remain at the south and east sides of this addition. At the area of the proposed expansion footprint we are proposing to relocate the existing handicap parking spaces further to the west and the landscaping adjacent to the existing entry and cul-de-sac will be Meridian Planning Department Wahooz F.E.C. Expansion November 24, 2015 Page 2 of 2 relocated to other parts of the property. There will minimal adjustments to the parking islands in the existing west parking lot, and most of the plant materials used will be relocated from areas that are being disturbed by the new construction with the intent of having no less than exists currently on the site. The building material palette for this proposal will copy colors and textures from the existing facility and add some splashes of color at the new entry elements. The general construction will be smooth faced CMU walls with a stucco finish coat on the west and south elevations which are considered the public sides of the building. The color scheme will use the browns and tan colors from the existing building applied in a similar manner for base and accent colors. The east and north walls that are out of the public view will be remain as is. The colored aluminum storefront doors and windows, standing seam metal roofing, playful signage and flagpole elements from the existing building will all coordinate together to create a fun and inviting main entry to the center. By completing the entry vestibule tower and adding the vibrant and scored stucco the building is getting closer to what was proposed in 2009. We believe the scale and mass of the single story structure is compatible with the existing building and surrounding uses and is consistent with the objectives of the Urban/Suburban Design Guidelines and trust positive findings will be made and a positive recommendation will result.
