APPROVAL OF TIME EXTENSION
This matter coming on regularly before the City Council on October 20 and November
17, 2015, upon the Applicant's submittal of a time extension application for the preliminary plat
for a two (2) year period of time within which to obtain the City Engineer's signature on the final
plat for the second phase of development of Woodland Springs Subdivision, which preliminary
plat was originally approved on December 18, 2007, as provided in Unified Development Code §
11 -6B -7C, and good cause shown. An administrative time extension (TE -10-006) for eighteen
(18) months was previously approved for this subdivision by the Planning Director on March 4,
2010 and would have otherwise expired on September 9, 2011. A second time extension (TEC -
11 -008) for a period of two (2) years was approved by the City Council on October 18, 2011 and

would otherwise have expired on September 9, 2013. A third time extension (TEC -13-007) for a
period of two (2) years was approved by City Council on October 15, 2013 and would otherwise
have expired on September 9, 2015 without submittal of the subject time extension request.
IT IS HEREBY ORDERED THAT:
The above named Applicant is granted an additional two (2) year extended period of
time, until September 9, 2017, within which to obtain the City Engineer's signature on
the second phase final plat, subject to the conditions of approval as shown in the attached
Staff Report for the hearing date of November 17, 2015 incorporated by reference.

The applicant, Woodland Springs, LLC, requests approval of a two year time extension (TEC) on the
preliminary plat for Woodland Springs Subdivision in order to obtain the City Engineer’s signature
on the final plat for the second phase of development.
II. STAFF RECOMMENDATION
Staff recommends approval of the subject time extension, to expire on September 9, 2017, with the
conditions included in Exhibit B.

V. UNIFIED DEVELOPMENT CODE
Per UDC 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to
obtain the City Engineer’s signature on the final plat within two years of the approval of the
preliminary plat.
Where the development of the preliminary plat is made in successive phases in an orderly and
reasonable manner, and conforms substantially to the approved preliminary plat, such segments, if
signed by the City Engineer within successive intervals of two years, may be considered for final
approval without resubmission for preliminary plat approval.
Upon written request and filing by the applicant prior to the termination of the allowed time period,
the City Council may authorize a time extension up to two years. With all extensions, the City
Council may require the plat to comply with current provisions of the UDC.
VI. PROCESS FACTS
A. The subject application is for a time extension. A public hearing is required before the City
Council on this matter, consistent with Meridian City Code Title 11, Chapter 5.

VII. HISTORY OF PREVIOUS ACTIONS:
A Comprehensive Plan Map Amendment (CPA-07-014), Annexation & Zoning (AZ-07-014), and
preliminary plat (PP-07-019) for Woodland Springs were approved by the City Council on
December 18, 2007. A development agreement (DA) was required with the annexation of the
property (Instrument No. 108022886). The Woodland Springs preliminary plat c onsists of 4
commercial building lots and 1 common lot on 7.55 acres of land.
The City Council approved the final plat (FP-08-003) for the first phase on April 1, 2008 and the
City Engineer signed the plat on September 9, 2009. Phase 1 was platted with 3 commercial
building lots and 1 common lot on 4.52 acres. The final plat has been recorded.
An 18-month time extension (TE-10-006) to obtain the City Engineer’s signature on the final plat
for the second phase of development was approved by the Director on March 4, 2010 and expired
on September 9, 2011.
A 2-year time extension (TEC-11-008) to obtain the City Engineer’s signature on the final plat
for the second phase of development was approved by the City Council on October 18, 2011 and
expired on September 9, 2013.
A 2-year time extension (TEC-13-007) to obtain the City Engineer’s signature on the final plat
for the second phase of development was approved by the City Council on October 15, 2013 and
expired on September 9, 2015. The request for the subject time extension was submitted prior to
the expiration date.
The Council approved an amendment to the Development Agreement (Inst. 108022886) (MDA-
15-004) earlier this year to change the architectural design and materials of the building proposed
to be constructed on Lots 3 & 4, Block 1. However, the agreement has not yet been signed,
approved by Council and recorded.

VIII. STAFF ANALYSIS
This is the fourth time extension requested for the subject preliminary plat. Approval of the subject
time extension will allow the applicant to proceed with the platting process for the second and final
phase of development. If the subject time extension is not granted, the preliminary plat would expire
for the remaining 3.03 acre portion of the site that has not been final platted and a new preliminary
plat would be required.
With all extensions, the City Council may require compliance with current provisions of the UDC as
a condition for granting a time extension (UDC 11-6B-7C).
Because the site is governed by a development agreement that requires compliance with building
elevations, a concept plan, site amenities and compliance with all City of Meridian ordinances in
effect at the time of development, no new conditions of approval were added with the first time
extension.
With the second time extension, a condition of approval was added for the developer to comply with
the recently adopted design standards listed in UDC 11-3A-19 and the design guidelines listed in the
City of Meridian Design Manual.
With the third time extension, conditions were added for the developer to comply with recently
adopted standards pertaining to installation of street lights, performance surety, and warranty surety.
Staff is currently in the process of proposing changes to the design standards listed in UDC 11-3A-19
and the guidelines listed in the Meridian Design Manual. As a condition of the subject time extension,
staff recommends future development of the subject property comply with the design standards in
effect at the time of development. Additionally, the UDC (11-3A-3) requires cross-access /ingress-
egress easements to be provided to adjacent properties when access to a local street isn’t available.
Pedestrian access is also required to be provided between commercial and residential d evelopments
per UDC 11-3B-9C.3. As conditions of approval, staff recommends a vehicular cross-access/ingress-
egress easement is granted to the property to the north and a pedestrian pathway is provided to the
north in the locations shown on the site plan in Exhibit A.3.
Staff recommends approval of the applicant’s request with the aforementioned conditions of approval.
All previous conditions of approval are also still applicable to development of this subdivision.

Exhibit B – Conditions of Approval
1. Applicant is to meet all terms of the approved annexation (AZ-07-014), development agreement
(#108022886), preliminary plat (PP-07-019), final plat (FP-08-003), and time extensions (TE-10-
006; TEC-11-008; TEC-13-007, H-2015-0002) for this development.
2. Future development of the site shall comply with the design standards in effect at the time of
development.
3. The applicant shall obtain the City Engineer’s signature on the second phase final plat for
Woodland Springs subdivision on or prior to September 9, 2017; or apply for a time extension in
accord with UDC 11-6B-7.
4. The applicant shall provide a vehicular cross-access /ingress-egress easement and a pedestrian
pathway easement to the property to the north (Parcel #S0529336100) in accord with UDC 11-
3A-3 and 11-3B-9C.3 respectively, in the locations shown on the site plan in Exhibit A.3. The
easements shall be provided via a note on the final plat or a separate recorded easement.
