Kissler LLC / Norco Meridian/ Development Agreement Modification Submittal Dear Mr. Parsons: Please find attached an application for the Modification of a Development Agreement on the proposed Norco Meridian Store to be generally located at the northeast corner of Eagle and Overland Road. This parcel of land was originally submitted to the City of Meridian in 1995 as an Annexation. The original conceptual plan proposed 700,000 square feet of retail space. The file numbers were MCU-7-95/MRZ-2-95. The original Owners and the Developer Langly Associates, Inc made the request. In addition to the annexation, the project was proposed as a "Planned Commercial Development'. There were several parcels of land involved with the submittal and the one currently owned by Jim Kissler (owner of Norco) was in the middle of the proposed Project. The Finding of Facts and Conclusions of Law were issued by the Meridian City Council on November 8, 1995. In the Findings of Fact and Conclusions of Law the City required the Developer to enter into a Development Agreement as noted on Page 31 of the Findings. The findings were approved by City Council and the annexation and zoning were completed. On April 17, 1996 Russell Keithly of Langly Associates withdrew their interest in the project and it never moved forward. As a result of the termination of the project the Development Agreement noted in the Finding of Fact and Conclusions of Law was never completed. Since the Annexation and Zoning of the property was approved with a condition that requires a Development Agreement be in place the City Staff has requested that we submit a new Development Agreement Application. In addition the Owner believes that since 20 years have passed, the new Development Agreement should be completed to address the specific development proposed for this specific site. The first phase of the proposed new project would include a new Norco Store of approximately 86,000 square feet of floor area. The building would be a two story building with a retail showroom for medical and industrial supplies. In addition the ground floor would have some areas necessary for warehousing and retail storage. The second floor of the building would house a new billing office for the medical side of Norco. The second phase of the project would include a commercial/retail store of 85,000 to 90,000 square feet. In addition to the second major retailer, there are three commercial pad sites shown on the Concept Plan. Since there are currently only three parcels owned by Mr. Kissler these pad P.O. The City should keep in mind that the users of the pad sites could be any use allowed in the zone. The site development for the Norco Project will include a modification to the existing traffic signal to allow for access from Overland Road into the Kissler site. In addition a private access road will be developed into the site to serve the Norco site, the future Major Retailer and the three future pad sites. This future access road would have a twenty-five (25') foot buffer along the residential to the east and the applicant is requesting a ten (10') foot buffer on the north as the applicant feels the property on the north will most likely develop as a commercial/mixed use project. The site will also have a service drive loop road system around the site for the Second Major. This will provide access to Norco until a user for the site is found and the site is developed. An emergency access is proposed off Rackham at this time. The Norco building will be two story building with a solid wall on the east that will abut the Second Major, a loading dock facility and second floor over the loading dock on the north. The project will be required to submit a Certificate of Zoning and Design Review Application to enable staff to review the proposed building. The Second Major will have the same requirements to submit the Certificate of Zoning Compliance and Design Review Application prior to any construction on the Second Major site. We have attached a Concept Plan with this application. It shows the general intent of the applicant. In addition we have included the items required on the Application checklist for the City's review. Phase I (Norco) of the project will employ approximately two hundred (200) people many of which currently reside in Meridian and commute to the Boise site daily. When completed this project will be a win for the City Meridian, the surrounding businesses and the Norco employees. We hope this application will meet with a favorable approval.
