This matter coming on regularly before the City Council on October 27, 2015, upon the
Applicant's submittal of a request for City Council review of a condition of approval (condition
#1.2.2 in the staff report attached to the Findings of Fact and Conclusions of Law and Decision
and Order) of the previously approved preliminary plat (PP -08-006) for Shops at Victory
Subdivision, which preliminary plat was originally approved on September 9, 2008, as provided
in Unified Development Code § 11 -6B -7C, and good cause shown. The current provision states,
"Prior to issuance of any CZC (Certificate of Zoning Compliance) and/or building permit, the
subject property shall be subdivided in accordance with the City of Meridian Unified
Development Code." The Applicant requested that the condition be modified to allow the
issuance of one building permit for the property for the development of a retail store prior to the
property being subdivided.

IT IS HEREBY ORDERED THAT:
The above named Applicant is granted one building permit for the subject property for
the development of a drug store prior to the property being subdivided, subject to the
conditions of approval as shown in the attached Memo from Staff dated October 19,
2015, incorporated by reference as revised per the Council's action.
