The applicant requests Council review of preliminary plat condition of approval #1.2.2 which states, "Prior to issuance of any CZC (Certificate of Zoning Compliance) and/or building permit, the subject property shall be subdivided in accordance with the City of Meridian Unwed Development Code." The applicant requests this condition is modified to allow one building permit to be issued for the property so they can construct a Rite Ai d drug store on the site prior to the property being subdivided. They agree to subdivide the property prior to further development of the site. See applicant's letter far more information. At the recent Council hearing for the time extension on the preliminary plat and conditional use permit for this property, the Council asked the applicant to remove the weeds and existing structures on the site within the next year. Development of t'�� Aid a drug store would facilitate this process. Because the subject parcel is considered an "original parcel of record" per the UDC (11-1A-1), this property would typically not be required to be subdivided prior to issuance of building permits. Therefore, staff is supportive of the applicant's request and recommends the condition is revised as follows: "Prior to issuance of any CZC and/or building permit beyond the lt' ked drug store on Pad A, the subject property shall be subdivided in accordance with the City of Meridian Unified Development Code. This allows tw dd a drug store to develop on Pad A prior to the property being subdivided." All other previous conditions of approval still apply to development of this site (AZ -08-007, Development Agreement Inst. 111032845; CUP -08-011; PP -08-006; TE -10-009; TEC -11-006; TEC -13-006; TEC -15- 004). Because this property has not been subdivided and is one parcel, the following items shall be completed with development of the Rite Aid store: 1. Street buffers are required to be constructed along the entire frontage of the property along S. Eagle Road & E. Victory Road. 2. Construct a 5-foot wide detached sidewalk along S. Eagle Road from the terminus of the existing sidewalk south ..,.«ess the Aldridge . rope fty to E. Falcon Drive (an attached sidewalk already exists along E. Victory Road and on the northern portion of the site along S. Eagle Road). 3. Construct a 6-foot tall verticrete wall along the entire southern boundary of the site adjacent to the property located at 3300 E. Falcon Drive as shown on the approved fencing plan (attached), as directed by City Council at the hearing on October 27, 2015. 4. Construct a landscape buffer along the entire southern and eastern boundaries of the site adjacentto residential uses as shown on the approved landscape plan (attached). 5. The applicant is required to reimburse the City for sewer and water mains built in Victory Road in conjunction with the ACRD EagleNictory intersection construction project; payment of $67,750.70 is due prior to commencement of any building construction on the site as set forth in the development agreement.
