Subject: Remarks regarding Sundial Circle subdivision for Oct 15 P&Z commission agenda
Commissioners:
Scheduling conflicts prevent me from attending the Oct 15 P&Z meeting, so I offer the following in lieu of verbal
comments:
• As noted in the agenda, the area being considered for the Sundial Circle (SC) subdivision is zoned R-4; thus, no
denser platting plan should be approved.
As you are no doubt aware, the proposed SC subdivision is entirely surrounded by the existing Sundial (S1)
subdivision — which is itself entirely surrounded by the Turtle Creek (TC) subdivision. Because Idaho law
unnecessarily complicates (in this case, at least) the incorporation of one subdivision into another, it is entirely
possible that the CC&Rs governing residents' behavior in SC could be entirely different from those of either S1 or TC.
Such a situation could create/exacerbate conflicts among neighbors in the immediate area of the entrance into SC;
the six houses on the west and east sides of the intersection of Whitelaw Dr. and the future cul-de-sac (i.e., four
existing structures and two future structures) will be subject to three separate sets of CC&Rs.
In view of this somewhat unusual situation, I would recommend that P&Z approve the SC plat only if the developer
agrees to adopt CC&Rs identical to those of 51. 1 am aware that the HOA board of S1 would eventually like to
combine S1 with SC, and — ultimately — with TC. Were SC's CC&Rs identical to those of S1, the likelihood of at least
that first step occurring would be greatly enhanced.
