DESCRIPTION OF APPLICANT'S REQUEST
The applicant, John Rennison, requests Certificate of Zoning Compliance (CZC) and Design
Review (DES) approval of a 480 square foot coffee kiosk w/drive thru on 1.17 acres of land in the
O -T zoning district. Alternative Compliance to UDC 11 -3A -19A.2, which prohibits prefabricated
steel panels as a finish material is also requested (see below for more information).
The site is located at 1648 N.W. 1 st Street.
ALTERNATIVE COMPLIANCE REQUEST
The applicant requests approval of alternative compliance to UDC 11-3A-19A.2b which prohibits
prefabricated steel panels as a finish material to be allowed to construct the building as proposed.
The proposed west, east and south elevations depict greater than 50% of the fagade to be bonderize
batten metal.
ALTERNATIVE COMPLIANCE FINDINGS:
In order to grant approval for alternative compliance, the director shall determine the
following findings:
1. Strict adherence or application of the requirements is not feasible; OR
The Director finds strict adherence to the requirements in UDC 11-3A-19A.2b is feasible;
however, due to the franchise owner's desire to maintain a consistent appearance with
other locations strict adherence to the requirements is not desired.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The Director finds the applicant's proposed alternative means of meeting the design
requirements provides a quality combination of materials that contribute to a cohesive
building, design. The metal complements the reclaimed wood siding and rusted metal
roofing and the subtle, neutral, natural colors of all the materials complement and unify
the building design.
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of the surrounding properties.
The Director finds that the proposed alternative means of complying with the City's
design standards will not be detrimental to the public welfare or impair the intended uses
and character of the surrounding properties.
DECISION
The applicant's request for Certificate of Zoning Compliance, Design Review and Alternative
Compliance is approved with the conditions listed in this report.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to
verify if you need a building permit and/or inspection. If you do need a building permit, you
must complete that process before you commence the use or construction. Please contact
Building Services for additional details about building permits and inspections.
Site Conditions of Approval
1. The applicant shall construct all proposed fencing and/or any fencing required by the
UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B.
2. Outdoor speakers are prohibited on this site per the development agreement.
3. Only right-in/right-out access via N. Meridian Road and one full -access driveway via
N.W. 1" Street are allowed.
4. Install signage in front of the two employee parking spaces or paint the stalls to
designate them as such.
5. Landscaping shall not obscure the view of the service windows from W. Cherry Lane
and N. Meridian Road in accord with UDC 11-4-3-11C.
6. Final approval of the property boundary adjustment application (PBA -15-018)
shall be obtained prior to issuance of Certificate of Occupancy.
7. The applicant shall submit a detail of the garden/art wall (with vegetation) at the
northeast corner of the site and way -finding signs on Cherry Lane and N. Meridian
Road for approval prior to issuance of Certificate of Occupancy.
8. An area shall be reserved at the northeast corner of the site for public art and/or
an entry sign to the downtown area if a partnership can be reached with the
Meridian Downtown Development Corporation (MDC) and the Meridian Art's
Commission (MAC) for the provision of these items in accord with the
development agreement.
General Conditions of Approval
100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public
roadways per the City of Meridian Improvement Standards for Street Lighting. All
street lights shall be installed at developer's expense. Final design shall be submitted as
part of the development plan set for approval. Applicant shall also include the location
of any existing street lights in the development plan set. Street lighting is required at
intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in
the Standards. The contractor's work and materials shall conform to the ISPWC and the
City of Meridian Supplemental Specifications to the ISPWC. Note: Per Austin Petersen,
only one Type 2 light is required to be installed on N. W. 1" Street directly behind the
sidewalk within the right-of-way; the Type I light on Meridian Road will not be
required Instead, the City will work with Idaho Power to upgrade the existing fixture on
the Idaho Power pole just north of the access on Meridian Road
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property,
the applicant shall submit a sign permit application consistent with the standards in
UDC Chapter 3 Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health
asset forth in UDC 11 -5C -3B. A surety agreement maybe accepted for other
improvements in accord with UDC 11-5C-3 C.
3. Upon installation of the landscaping and prior to inspection by Planning Division staff,
the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -
14A.
4. The site plan prepared by Rennison Engineering on 10/1/15, labeled Sheet C1.0, is
approved as shown in Exhibit B.
5. The landscape plan prepared by Rennison Engineering on 9/24/15, labeled Sheet L1.0,
is approved as shown in Exhibit C.
6. The elevations prepared by Evergreen Architecture on 9/25/15, labeled Sheet A3.0, are
approved as shown in Exhibit D.
7. The approved site plan, landscape plan and/or elevations may not be altered without
prior written approval of the City of Meridian Planning Division.
8. The applicant shall pay any applicable impact fees prior to the issuance of a building
pen -nit.
9. If any changes must be made to the site plan to accommodate ACHD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Division for
approval prior to issuance of the building permit.
10. The applicant shall complete all required improvements prior to issuance of a Certificate
of Occupancy. It is unlawful to use or occupy any building or structure until the
Building Official has issued a Certificate of Occupancy.
11. The City of Meridian requires that the owner enter into a Warranty Surety Agreement
and post a Warranty Surety in the amount of 20% of the total construction cost for all
completed public sewer and water infrastructure for a duration of two years. This surety
amount will be verified by a line item final cost invoicing provided by the owner to the
City. The surety can be posted in the form of an irrevocable letter of credit, cash deposit
or bond, and must be in place prior to Certificate of Occupancy. Applicant must file an
application for surety, which can be found on the Community Development Department
website. Please contact Land Development Services for more information at 208-887-
2211.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation
that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all
landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as set
forth in UDC 11-3A-14,
3. The project is subject to all current City of Meridian ordinances and previous conditions
of approval associated with this site (RZ-15-010; CUP -15-014).
4. The issuance of this CZC does not release the applicant from any previous requirements
of the other permits issued for the site.
5. The applicant and/or property owner shall have an ongoing obligation to prune all trees
to a minimum height of six feet above the ground or sidewalk surface to afford greater
visibility of the area.
6. The applicant has a continuing obligation to comply with the outdoor lighting provisions
as set forth in UDC 11-3A-11.
7. The applicant and/or property owner shall have an ongoing obligation to maintain all
landscaping and constructed features within the clear vision triangle consistent with the
standards in UDC 11-3A-3.
8. The applicant and/or assigns shall have the continuing obligation to meet the specific
use standards for the proposed use as set forth in UDC 11-4-3-11, Drive -Through
Establishment.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division on or
before October 24, 2015, within fifteen (15) days after the written decision is issued, and
contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the
use has not commenced within one year of the date of issuance of the Certificate of Zoning
Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a
structure shall expire if the construction or alteration has not commenced within one year of the
date of issuance of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
October 9, 2016.

Dear Caleb and Sonya,
On behalf of the Ada County Highway District (ACHD) (as Owner) and B & S Investments, LLC (as Developer), please
accept the enclosed development applications referenced above for consideration. The Owner and Developer
desire to redevelop the southwest corner of Cherry Lane and Meridian Road, an approximate 1.17 -acre property
located at 1648 NW 1n Street in Meridian. The subject property previously contained single-family residences and
other commercial uses, but ACHD acquired the property for the recent Split Corridor Project and demolished pre-
existing structures. The redevelopment plans include a Human Bean drive-through and walk-up coffee store, a
future restaurant, and other future potential retail uses. The property has been approved for rezone (RZ-15-010)
from R-4 (medium -low density residential) to O -T (Old Town). The drive-through coffee store has been approved
through the Conditional Use Permit (CUP -15-014) process.
Certificate of Zoning Compliance
As part of approval of ZOA-15-001, RZ-15-010, and CUP -15-014, Site Specific Conditions of Approval for this project
include the following items that are reflected in the Certificate of Zoning Compliance (CZC) site and landscape plans:
1. 1.1.1.c. and 1.1.3.d. A detail of the garden wall is attached.
2. 1.1.1.g. and 1.1.4.d. A copy of the cross -access easement to the property located to the south at 1611
N. Meridian Road will be provided to the City once recorded. A copy of the exhibit showing the proposed
easement is included in this submittal. The proposed easement is also illustrated on the attached CZC site plan.
3. 1.1.3.c. Seating, way -finding signs, and trash receptacles have been added within the street buffers along
N. Meridian Road and W. Cherry Lane on the attached CZC site plan.
4. 1.1.4.a. A sample photo of the proposed bike rack is included in this submittal. The bike rack was installed at
the recently -constructed Human Bean in Garden City. The proposed location is shown on the attached CZC site
plan and provides adequate bike parking area outside of the adjacent sidewalk.
5. 1.1.4.d. Employee parking stall requirements are shown on the attached CZC site plan.
6. 1.1.5. An exhibit showing the proposed cross-access/cross-parking easement is included in this submittal. The
proposed easement is also illustrated on the attached CZC site plan.

Design Review
A complete set of scaled plans including building elevations, with building materials, colors and textures specified
and site plans are included in this submittal along with completed Design Manual Compliance Checklists.
The building footprint is approximately 480 square feet, though the architectural design of the freestanding
building is far from the appearance of a somewhat typical kiosk coffee store. The developer has successfully
rebranded the look of The Human Bean store in our market with the recent 2014 opening of a Caldwell store and
2015 opening of a Garden City store. Please see attached photo of the Caldwell store.
The proposal addresses guidelines contained in the Meridian Design Manual and UDC 11-3A-19 as follows:
1. Architectural Character.,
a. Facades: Building facades visible from o public street or public space shall incorporate modulations in the
facade, including, but not limited to, projections, recesses, and step backs that articulate wall planes and
break up building mass. Facades shall be modulated and articulated in accord with the "City Of Meridian
Design Manual"
The architectural design concepts blend reclaimed wood, metals of various finish, brick and other accents
creating a fresh and unique appearance that adds depth to the fagade. The sloped roof cantilevers over
one walk-up and two drive-through windows to incorporate modulation in the fa4ade.
b. Primary entrance(s): The primary building entrance(s) shall be clearly defined by the architectural design of
the building.
Along with the building's window locations, the sloped roof cantilevers over one walk-up and two drive-
through windows to clearly define the primary building storefront.
c. Roof lines: Roof design shall provide variations in profile through modulation and/or articulation in accord
with the "City Of Meridian Design Manual", including, but not limited to, the following: 1) overhanging
eaves, 2) sloped roofs; 3) two (2) or more roof planes; 4) varying parapet heights; and 5) cornices.
The sloped roof cantilevers over one walk-up and two drive-through windows to incorporate modulation
and articulation. A portion of the building has the appearance of having two stories.
d. Pattern variations: Architectural building design shall not create blank wall segments along public streets
and/or adjacent public spaces. Architectural elements, including, but not limited to, windows, awnings and
arcades, shall have color, texture and/or materials to mitigate blank walls.
The architectural design concepts blend reclaimed wood, metals of various finish, brick and other accents
creating a fresh and unique appearance.
e. Mechanical equipment., All ground level mechanical equipment shall be screened to the height of the unit
as viewed from the property line. All rooftop mechanical equipment shall be screened as viewed from the
farthest edge of the adjoining right of way.
A rusted metal plate that hangs from a rusted tube steel frame will serve as a decorative screen between a
ground -level air conditioning unit to the south of the building and N. Meridian Road. A sample photo of
the proposed decorative screen is included in this submittal (at the discretion of the owner, the logo may
not be included on the screen). Several screens were installed at the recently -constructed Human Bean in
Garden City as an artistic feature. The proposed location is shown on the attached CZC site plan.
2. Materials: (a) Exterior building designs shall demonstrate the appearance and use of high quality materials,
including, but not limited to, stone, brick, wood or other natural materials, tinted or textured masonry block,
textured or architecturally detailed concrete panels, or stucco or stuccolike synthetic materials. (b) Smooth faced

concrete block, prefabricated steel panels, and/or vinyl are prohibited as finish materials but may be approved
as accent materials in accord with the "City Of Meridian Design Manual. "(c) Untextured concrete panels are
prohibited as finish and/or accent materials.
Conceptual elevations and renderings are included in this submittal. The architectural design concepts blend
reclaimed wood, metals of various finish, brick and other accents creating afresh and unique appearance.
3. Parking lots: For properties two (2) acres or less in size, a maximum of a single drive aisle with parking on one or
both sides shall be allowed between the building facades and abutting streets. All other off street parking areas
shall not be located between the building facades and abutting streets.
In reasonable conformance with the design recommendations (FLUM cut sheet for Old Town), building pads
are generally brought to street side with parking to the rear and center. Parking provided on this site far
exceeds the minimum requirement. All parcels within the development will provide for reciprocal cross -
parking and cross -access to the public right-of-way.
Drive-through lanes are screened by plantings as well as a garden wall at the street corner to obscure
headlights and views of vehicles in the queue from the public right-of-way. Please refer to the attached
landscape plans.
4. Pedestrian walkways and facilities: (a) A continuous internal pedestrian walkway that is a minimum of five feet
(5) in width shall be provided from the perimeter sidewalk to the main building entrance(s)for nonresidential
uses. The walkway width shall be maintained clear of any obstructions, such as vehicles, outdoor sale displays,
vending machines, or temporary structures. (b) The internal pedestrian walkway shall be distinguished from the
vehicular driving surfaces through the use of pavers, colored or scored concrete, or bricks. (c) Unobstructed
walkways at least five feet (5') in width shall be provided for any aisle length that is greater than one hundred
fifty (150) parking spaces or two hundred feet (200') away from the primary building entrance(s). (d) The
walkways shall have weather protection (including, but not limited to, an awning or arcade) within twenty feet
(20) of all customer entrances.
In reasonable conformance with the design recommendations (FLUM cut sheet for Old Town), pedestrian
connections to and through the site are provided. The Human Bean business model caters pedestrian
customers via the integrated walk up service area.
(a) A continuous internal 5' -wide pedestrian walkway is provided from the N. Meridian Road sidewalk to the
coffee store walk-up window. The walkway continues to the west through the site and will be extended upon
further development of the site. (b) The internal pedestrian walkway is composed of scored concrete.
(c) Requirement does not apply. (d) An awning that extends five feet from the coffee store walk-up window is
provided and is considered sufficient to provide weather protection.
Property Boundary Adiustment
The existing lots are part of Wilson Addition to Meridian subdivision (Book 12, Page 708), September 1948.
Portions of the lots were taken as W. Cherry Lane and N. Meridian Road right-of-way per RWT Instrument
No. 111025845 (reference Record of Survey No. 9631) in 2014. Despite not being reflected on Ada County
Assessor's records (listed as Parcel No. R9453000007, 1648 NW 1n Street, 1.172 acres), it appears thatthese lots
are still in existence. Parcels 1, 2, and 3 as shown on the attached Record of Survey Parcel Consolidation and on
attached site plan (Sheet C1.0) are proposed. The proposed The Human Bean coffee store will be located on
Parcel 1. A future restaurant will be located on Parcel 2 near the intersection of W. Cherry Lane and NW 1n Street.
A future retail/restaurant will be located on Parcel 3 at the southwest corner of the site. Proposed easements for
the following purposes are attached for review:
