Broadway, Suite 102 Meridian, ID 83642 Re: Application for Development Agreement Modification Southridge Apartments (RZ 11-002) as required by approval of Southridge Estates Subdivision Dear Planning Division: We are pleased to submit the enclosed applications for Development Agreement Modification of the Southridge Apartments (RZ 11-002). The project is located south of W. Overland Rd. and west of S. Linder Rd. within the City of Meridian. Background In 2011, the Southridge Apartments portion of the overall Southridge Development was rezoned for an apartment project and entered into a Development Agreement with the City of Meridian which was recorded as Instrument Number 111099621. The Development Agreement included a concept plan for the project which included in its southeastern portion an area without a defined use indicated as "Phase III — To be Determined". Earlier this year, a preliminary plat (and accompanying applications) was presented for the Southridge Estates Subdivision. This preliminary plat proposed single-family residential lots within a portion of this "Phase III" designated area. The preliminary plat has now been approved bythe Meridian City Council, pending modification of the Southridge Apartments Development Agreement to update the Master Concept Plan for the area of "Phase III" so that the Master Concept Plan reflects the proposed single-family residential lots. Specifically, the Southridge Estates Subdivision Conditions of Approval (Item 1.1.12) state: 1.1.12 Prior to City Council approval of the subject rezone and preliminary plat, the existing development agreement (recorded as Instrument No. 1 1 1 099621) for Southridge Apartments shall be modified to update the conceptual development plan consistent with the layout of the proposed plat.
