The Director may approve or deny specified minor modifications, provided such modifications were not the subject
ofreview during the original public hearing and will not adversely impact adjacent properties (see UDC 11 -5B -
6G2). All other modifications shall be considered by the Planning and Zoning Commission at a public hearing.

To whom it may concern:
Blvislo,n 360 is requesting an alternative compilance waiver to landscape, other
than grass, a 10' strip on the southern border of the recently approved Verraso
project (CUP 15-012). The specific requirement is UDC 11 -3B -7C3. Which states
landscape buffers and the landscaping requirements. The area in question has a
major irrigation lateral with minimal (12") of dirt cover. In discussions with Greg
Curtis, Water Superintendent for Nampa Meridian Irrigation district, he indicated
NMID does not want ahythtng planted (other than grass) M these areas. In an
email (enclosed) Gretchen Flores who is the Shop secretary for NMID cites code
42-1208 which obstructions in NMID rights of way. Greg was also concerned
over the trees root structure and damaging effects. It is clearly unsuitable for
landscape other than the proposed grass. To off set the lack of landscaping we
have compensated by additional landscaping in the courtyard of the Verraso
project. Out vision was to create a courtyard in smaller fashion to the Village at
Meridian. The environment will create a unique "one -of -a -kind" project yet to be
seen in Meridian. We ask you to approve our alternative compliance waiver
when this exact situation is what the waiver was designed for. Thank you in

What I was able to find was in our District's user guide that has Idaho Code in it. Greg said your situation would
pertain to Title 42 Chapter 12 on the maintenance and repair of ditches.
It is code 42-1208: Rights of way not subject to adverse possession
Rights of way of irrigation districts, Carey act operation companies, non-profit irrigation entities, and lateral
ditch associations, are not subject to adverse possession, and no person shall prevent free access of
authorized personnel on rights-of-way or construct any obstruction on rights-of-way in an effort to adversely
possess said right-of-way.
Q: WHY DOES THE DISTRICT CUT DOWN SOME OF THE TREES AND BRUSH
ALONG THE CANALS, DITCHES, OR DRAINS?
A: Although the trees and brush along a canal, ditch, or drain may appear to some people as
aesthetically pleasing, they can present a problem for Nampa & Meridian Irrigation District. The
trees and brush reduce the efficiency of the canal and a larger percentage of the water conveyed
in the canal is "lost" due to the vegetation. By controlling, but not eliminating, vegetation along
the canals or drains, more water is available to irrigate the land. When trees or brush fall into a
canal, ditch, or drain, the blockage can cause flooding or an increase in groundwater. Removing
certain trees or brush in advance helps reduce cost and danger.
