The applicant, James Hagen, requests Certificate of Zoning Compliance (CZC) approval for a
change of use from professional service to vehicle sales on 0.263 acres of land in the C -G
zoning district.
The site is located at 703 S. Meridian Road.
DECISION
The applicant's request for Certificate of Zoning Compliance is approved with the conditions
listed in this report.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to
verify if you need a building permit and/or inspection. If you do need a building permit, you
must complete that process before you commence the use or construction. Please contact
Building Services for additional details about building permits and inspections.
Site Conditions of Approval
1. Access to the site is gained through cross access of ACHD property/right-of-way off W
Waltman Lane. Vehicle display and customer parking are prohibited on any part of
ACRD property/right-of-way.
2. Vehicle display is prohibited behind any part of the customer parking spaces. No
vehicle display is permitted east of the line formed from the tip of the landscape
planter island down to the property line (line runs north/south), as shown in
Exhibit B. This area must remain clear and open so as to provide for customer
maneuverability.
3. Applicant shall install a bench near the customer entrance closest to the parking
area. Detail and location of bench shall be provided to the Planning Division prior to
installation for design approval. Such detail shall be provided with the Building Division
submittal.
4. Applicant shall install at least one bike rack on site. Detail and location of bike rack
shall be provided to the Planning Division prior to installation for design approval. Such
detail shall be provided with the Building Division submittal.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the
property, the applicant shall submit a sign permit application consistent with the
standards in UDC Chapter 3 Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health
asset forth in UDC 11 -5C -3B. A surety agreement maybe accepted for other

improvements in accord with UDC 11 -5C -3C.
3. Upon installation of the landscaping and prior to inspection by Planning Division staff,
the applicant shall provide a written certificate of completion as set forth in UDC 1I -
3B -14A.
4. The site/landscape plan prepared by Chad Olsen and Pro -Vision Landscape on August
5, 2015, is approved as shown in Exhibit B, with the following comments:
a. The customer parking landscape planter shall be no less than five feet (5') in
any dimension, measured inside curbs, and contain a minimum of fifty (50)
square feet per UDC 11 -3B -8C2. The only exception to the five foot (5')
dimension is at the tip of the triangular planter.
b. Parking lot landscape planter shall contain at least one deciduous shade tree
pruned to a minimum height of eight feet (S') per UDC 11-3134CM. It shall
also contain shrubbery.
c. Mulch shall be used in the parking lot landscape planter per UDC 11 -3B -
5H. Approved mulches may be organic, such as bark or soil aid, or they may
include rock products, such as "permabark" or similar products. Use of mulch,
organic or rock, as the only ground cover in required planting areas is prohibited.
Pea gravel, drain rock, road base gravel, and similar products shall not be used as
mulch ... If rock mulch is used, a weed barrier fabric shall be used beneath the
rock. Impermeable plastic weed barriers are prohibited because they restrict
water and oxygen to the plants.
5. The approved site/landscape plan may not be altered without prior written approval of
the City of Meridian Planning Division.
6. The applicant shall pay any applicable impact fees prior to the issuance of a building
permit.
7. If any changes must be made to the site plan to accommodate ACRD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Division for
approval prior to issuance of the building permit.
8. The applicant shall complete all required improvements prior to issuance of a Certificate
of Occupancy. It is unlawful to use or occupy any building or structure until the
Building Official has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation
that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all
landscaping as set forth in UDC 11-313-5, UDC 11-3B-13 and UDC 11-3B-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as set
forth in UDC 11-3A-14.
3. The project is subject to all current City of Meridian ordinances and previous conditions
of approval associated with this site (PBA -09-003).
4. The issuance of this CZC does not release the applicant from any previous requirements
of the other permits issued for the site.
5. The applicant and/or property owner shall have an ongoing obligation to prune all trees
to a.minimum height of six feet above the ground or sidewalk surface to afford greater
visibility of the area.
6. The applicant shall have an ongoing obligation to maintain all pathways.
7. The applicant has a continuing obligation to comply with the outdoor lighting provisions
as set forth in UDC I1 -3A-11.
8. The applicant and/or assigns shall have the continuing obligation to meet the specific
use standards for vehicle sales as set forth in UDC 11-4-3-38.

CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division on or
before September 14, 2015, within fifteen (15) days after the written decision is issued, and
contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.

Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the
use has not commenced within one year of the date of issuance of the Certificate of Zoning
Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a
structure shall expire if the construction or alteration has not commenced within one year of the
date of issuance of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
August 28, 2016.

ACHD does not have any required improvements for this application for car sales. However, it should be noted that the
applicant cannot use ACHD property/right-of-way forvehicle display. Access to this parcel is across ACHD property, but
any parking requirements for the business are to be met on-site; and display vehicles cannot be located on ACHD
property.
