CZC 15-089CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: August 26, 2015 TO: Charlie Shen FROM: C.Jay Coles, Assistant City Planner SUBJECT: CFT Meridian - CZC-15-089 and DES -15-076 OWNER: Wal-Mart Stores Inc DESCRIPTION OF APPLICANT'S REQUEST The applicant, Charlie Shen, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval of a Multi -tenant retail building with drive-thru on 2.11 acres of land in the C -G zoning district. The site is located at 4865 N. Ten Mile Road. CZC-15-089 and DES -15-076 approve the site design and Total Retail GLA and PX building only. DT Pad 1 will require separate CZC and DES approval. DECISION The applicant's request for Certificate of Zoning Compliance and Design Review is approved with the conditions listed in this report. Note: This is not a buildingpermit. Please contact Building Services at (208) 887-2211 to verb if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. General Conditions of Approval 1. 100 Watt and 250 Watt, high-pressure sodium street lights shall be required on all public roadways per the City of Meridian Improvement Standards for Street Lighting. All street lights shall be installed at developer's expense. Final design shall be submitted as part of the development plan set for approval. Applicant shall also include the location of any existing street lights in the development plan set. Street lighting is required at intersections, corners, cul-de-sacs, and at a spacing that does not exceed that outlined in the Standards. The contractor's work and materials shall conform to the ISPWC and the City of Meridian Supplemental Specifications to the ISPWC. Process Conditions of Approval 1. Per UDC 11-513-5132, the Director (at the applicant's request) approved alternative compliance (ALT -15-014) to modify the landscape buffers adjacent to McMillan and Ten Mile Roads and convert two (2) of the internal planter islands into brick patios for outdoor seating. 2. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 4. Upon installation of the landscaping and prior to inspection by Planning Division staff, the applicant shall provide a written certificate of completion as set forth in UDC 11- 3B -14A. 5. The site plan prepared by Gary Wang & Associates, labeled A-0.1, is not approved as shown in Exhibit B and shall be revised as follows: a. One bicycle parking facility (bike rack) should be placed next to "Total Retail GLA" and/or "PX" as labeled on the site plan. b. UDC 11 -3C -5B3 requires wheel restraints to prevent cars from encroaching onto sidewalks and/or landscaped areas of six feet (6') or less in width. Wheel restraints are required at the North West parking area. c. All parking stalls shall meet the requirements of UDC 11-3C-5 and shall be no less than nine feet (9') in width. 6. The landscape plan prepared by PacLand on August 17, 2015, labeled L-1.0, is approved as shown in Exhibit C. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 8. The elevations prepared by Gary Wang & Associates, labeled A-2.0, are not approved as shown in Exhibit D and shall be revised as follows: a. On the west elevation (rear) incorporate a middle accent band as depicted on the north and south elevations and as required per CUP -15-011. 9. Patios shall be installed per Exhibit A.3 of CUP -15-011, sheet labeled A-0.3 10. The applicant shall pay any applicable impact fees prior to the issuance of abuilding permit. Requested revisions shall be submitted with the Building Division Submittal. 11. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 12. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 13. Prior to Certificate of Occupancy, the applicant shall record a cross-access/ingress- egress easement to Lot 2, Block 1 of Coleman Subdivision and submit copy of said easement to the Planning Division in accord with the provisions of UDC 11 -3A -3A2. 14. Per ALT -15-014, prior to Certificate of Occupancy, the decorative entry feature (three (3) trellis' and the raised planter with seating) near the intersection, the berm with a mix of shrubs, grasses and trees and the four (4) 5' x 5' planter islands in the internal area of the parking lot, and the patios must be constructed as shown in Exhibit A.3 of CUP -15- 011. 15. All existing landscaping in the construction zone must remain protected during construction on the site. The City of Meridian Parks Department Arborist shall approve the protection fence(s) prior to construction for any existing trees. Contact the City Arborist at 208-888-3579. 16. The pedestrian walkway proposed to be extended into the development to provide connectivity from the north to the front of the building must be delineated from the driving surface by pavers, brick or scored concrete in accord with UDC 11 -3A -19A4. The proposed pathway extending into the development from the south shall also be in accord with UDC 11 -3A -19A4. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-3B-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (FP -15-002; PP -14-016; CZC-13-047; DA #110051282; CUP -15-011; CUP -15-013). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. S. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for a drive-through establishment as set forth in UDC 11-4-3-11. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before September 10, 2015, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. It invites both the pedestrian and vehicle into the site, with an optimum parking layout. Locating the main retail building along the street will present an uninviting "back of house" that is not pedestrian -friendly. In addition, people would have to cross a drive-thru lane to access the site, then walk all the way around to the front of the building to patronize the businesses. 2. The alternative compliance provides a superior means for meeting the requirements of landscaping and aesthetics. If the main retail building were situated along the street, all that would be visible would be the back of the building, drive thru menu, and drive-thru window. It would not be a pedestrian - friendly setup, as the passer-by would feel like they were driving behind the building. The current site plan invites the pedestrian into the site with the corner architectural feature, seating, and trellises. A 3' high berm with 18" hedges on top serves to screen the main parking field from general street view. In addition, diamond planters with parking lot trees have been placed within the parking spines to further soften and screen the parking lot. An enhanced street corner, with trellises, floral fountain, and seating provides a place to rest and also serves as a gateway into the site. 3. The alternative means is not materially detrimental to the public welfare, as it asthetically enhances the streetscape with additional landscaping while inviting the pedestrian into the site. Clear signage will further enhance and direct customers into the site from both the street and walmart parking lot. In effect, setting the buildings away from the street corner helps to complement the southeast corner development, as that one is also set back from the street. The one property owner that attended my neighborhood meeting was excited to see new development in the area, especially the Panda Express. He expressed that there is a need for restaurants in Meridian, as most people have to leave the city to go eat. With all the new residential development, there will be even more demand. The current layout will both accommodate the existing and future demands of the area.
