Re: Sovi Subdivision – AZ-15-007; PP-15-010
Dear Council Members:
I am writing this document to clarify what was approved at the Planning and Zoning
Commission hearing for the Sovi Subdivision Annexation and Preliminary Plat applications.
Our comments on the staff report are as follows:
1. Parcel Acreage
The staff continues to note that the plat consists of 5 acres of land. The boundary survey
prepared by Sawtooth Land Surveying, LLC verifies that this infill property consists of 4.86
acres; please see “Attachment A”. Even though the UDC does not require open space or an
amenity for developments that are 4.86 acres, we are providing both 8.4% of qualified open
space (14.5% open space total with the drainage swale included) and a qualified amenity, i.e., an
improved common picnic/barbeque area in the open space. Our project goes beyond the UDC
requirements and meets the spirit of what would be required of a larger development.
2. Vehicular Connection to Messina Village Subdivision
Condition 1.1.2.a of Exhibit B has an original item regarding extension of S. Milan Ave
to the property’s south boundary. This was discussed by the Planning and Zoning Commission
and formally acted to change this condition and remove the requirement to extend Milan to the
property’s south boundary. The Commission noted Ada County Highway District’s (ACHD)
opposition of a stub road to or across land the applicant does not own will not be supported.
Commission members noted it did not make sense to encumber the developer with a condition
that will not be approved by the adjacent landowner and the ACHD.

We have provided for secondary emergency access with an emergency-only road over
Lot 10 to Rome Drive, which the Meridian Fire Department has found acceptable and approved
by the Planning and Zoning Commission.
3. Common Driveways
Condition 1.1.5 states that Lots 18, 19, 21, 22 and 23, 27, 28, 32, 33, 34, 35, Block 1 shall
take access from common driveway as proposed AND Lots 7, 8, 9, 11, 12, 13, Block 1 if the
Commission and Council approve the use of the common driveway as shown. During the
Planning and Zoning Commission hearing, the Commission approved the use of common
driveways for the Sovi Subdivision as they “comply with all the requirements of the Unified
Development Code”.
In summary the Planning and Zoning Commission approved this development as follows:
- with the verified land size of 4.86 acres
- removal of the condition 1.1.2.a to extend Milan Avenue to the southern property
line
- approved with the use of Common Driveways as depicted on the plat and noted in
condition 1.1.5
We respectfully request that you approve our proposed development based on Planning
and Zoning Commission’s conditions of approval recommendations.
