RE: EASY JET SUBDIVISION - REZONE / CUP / PRELIMINARY PLAT LETTER OF INTENT Dear Ms. Watters, On behalf of Reginald Jones, please accept this request for Rezone, Conditional Use Permit (CUP) and Preliminary Plat for the Easy Jet Subdivision, located on the southeast corner of Eagle Road and Easy Jet Way, Meridian, Idaho. The proposed development includes a total of 7 lots on 5.41 acres, with 2 lots for commercial/office uses, 4 lots for apartments containing 76 dwelling units, detached covered parking structures and 1 lot for common areas. The property is currently zoned R-4 (Medium -Low Density Residential). Background In 2002, the City of Meridian approved a Planned Unit Development (PUD) recognized as the Sutherland Farm Subdivision. The original master plan included a mix of land uses incorporating a total of 308 building lots over 127.74 acres. Of those uses, a proposed 260 single-family detached residential lots, 32 attached/multi-family residential lots, 11 office lots and 5 commercial lots were proposed. The approved zoning included R-4 (Medium -Low Density Residential) and C -G (General Retail and Service Commercial) with the condition that the R-4 areas would later be rezoned and/or necessitate a CUP to allow for additional public comment and City review. The Sutherland Farm Development today includes a total of 334 detached residential lots, 28 townhome lots, 4 multi -family lots and 2 commercial lots. Easy Jet Drive, the main point of ingress and egress from the proposed development, has been signalized and constructed as a commercial/industrial roadway complete with curb, gutter and sidewalk to meet Ada County Highway District (ACHD) standards. In addition, Eagle Road has been widened to four lanes south of Overland Road to Victory Road including a center turn lane. The actual zoning within the subdivision is a mix of uses including R-4, R-8, and L -O. The proposed multi-family/commercial development completes the original mixed-use PUD master plan for the Sutherland Farms Development by incorporating a variety of housing types and by adding employment and commercial opportunities within the community. Rezone The existing zoning for the subject property is R-4 (Medium -Low Density Residential). The request is to rezone 4.82 acres to R-15 (Medium -High Density Residential) and 1.73 acres to L- O (Limited Office). The proposed zoning designations comply with the City of Meridian Comprehensive Plan which identifies Mixed Use in the project area. The Comprehensive Plan indicates MU—C (Mixed Use Community) to the east, west, north and south. Providing Mixed Uses in the community meets the goals of the City of Meridian Comprehensive Plan. Many of the goals relate to providing housing opportunities for all groups within the community, to establish efficient uses of land, to encourage economic growth and to encourage development of quality housing. Conditional Use Permit According to Table 11-2A-2 of the Meridian City Code, a multi -family development in the requested R-15 zoning district is an allowed use with an approved CUP. Personal and Professional Services are allowed in the L -O zoning district by code, but separate permits for each tenant will be analyzed and determined on a project by project basis. The proposed development as planned will include two lots intended for limited office and light retail uses, four lots with three 3 -story and one 2 -story apartment buildings, and one lot for common areas, including detached covered parking structures. There are no new public streets proposed, as access to the site will come directly from Easy Jet Way at two locations. Water and sewer services will be provided by the City of Meridian and is available within Easy Jet Way. The primary source of pressurized irrigation will be provided through the existing Sutherland Farm system maintained by the Sutherland Farm Homeowner's Association.- City of Meridian code requires one amenity for every 20 acres of development area. The Easy Jet Subdivision intends to provide five of the various types of amenities listed in city code. These include a club house, play structures, fitness facilities, picnic areas, and connectivity to the right-of-way. Other amenities will include a 50' x 100' open area at the club house, covered parking, garage parking and a court yard on the west end of the multi -family buildings, buffering the apartments from the commercial parking area. Elevations of the multi -family apartment buildings are included with our application. Materials used on the facades of the buildings will reflect the high-quality aesthetics in the surrounding neighborhood. Preliminary Plat The design of the project is intended to transition from the existing single family residential uses to multi -family residential uses to commercial uses. The 5.41 acre property will be divided into 7 lots. 4 multi -family lots, 2 commercial lots and 1 large common lot that will include the clubhouse, play structures, picnic areas, drive aisles, parking and garage units. Lighting has already been installed along Easy Jet Drive. Trees, shrubs, various grasses and ground cover will be planted within the site, within a 25' landscape buffer adjacent to S. Eagle Road and within a 20'landscape buffer adjacent to E. Easy Jet Drive, S. Nephrite Way and the single family property that is bordering this project to the south. We have read through and discussed your public notice (copy attached) in which you describe your clients' intent to build multi -family housing units in a high density pattern with access directly to Eagle Road on the East side of Eagle Rd and joining with Easy Jet Drive. There is no nice way of putting this: your entire concept will grossly and negatively impact Thousand Springs; with serious negative effects on the quality of life and the property values in Thousand Springs, as well as our neighbors in Sutherland Farms and Tuscany subdivisions. The cause of this negative impact is by common sense easy to see and understand. With 76 new apartments and at least a half-dozen other commercial business enterprises packed into an area of less than two city blocks, all traffic feeding from Easy Jet Drive as access to Eagle Road that is currently already pressed will become nothing short of impossible. Your petition to get the City and County to Re -Zone is simply out of step with both timing and limitations of existing infrastructure. Easy Jet Drive only accommodates two lanes at a single traffic signal to get on and off Eagle Road in Meridian —just north of another traffic signal at Victory Road within 2 blocks of Easy Jet. This small, two lane road is already overloaded and traffic is taxed daily attempting to just get on and off Eagle Road safely. Eagle Road is notably one of, if not the, single most heavily trafficked roads in Ada County and even in the State of Idaho. Pepperidge Elementary School serving students East of Eagle Road is already in a crowded capacity. Traffic is slammed and students are at a high risk crossing streets to get to school. Your proposal would place additional and unnecessary strain on school enrollment and children's safety. Sienna Elementary School in Tuscany —just south of Victory Road, off Eagle Road, is already seeing issues with classroom crowding. School vehicle and pedestrian traffic getting across Eagle Road as well as Victory are also hard pressed. Children are crossing at a single cross walk out of Thousand Springs along Victory Road at a single traffic signal just for them. There is no school zone or bus stop either immediately on Eagle Road, or directly along Easy Jet to the West of Eagle Road. Your petition, if passed, would unreasonably and dangerously disrupt for long and unnecessary periods the flow of traffic, the peace of our community, and the security of our neighborhoods. The entire community around Victory and Eagle Roads waited two years just to get essentially four blocks of a two lane road widened and over the Ridenbaugh Canal at Eagle Road. The process was ungodly and took way too long. Your proposed project would set traffic flow and safety back years. Your project impacts the community in every way imaginable, yet none to the good. You are too late and expect far too much than what your small block of land can handle or accommodate. You need to be back to the drawing board. Frankly, it's this type of high density attitude, throwing caution and common sense to the wind that instigates demands for strong mandatory impact fees and higher and higher taxes. We strongly urge your client landowners / investors to look elsewhere for this type of high impact development. We don't want or need it here. We were interested about the comment in your proposal as respects `open space and amenities". It would seem prudent planning given an average standard of expectation (particularly in light of the larger difficulties we've already faced with this impacted area) to expand, describe and detail those "open space and amenities" in far greater emphasis than what has thus far been shared. Hopefully, another review will incorporate items such as: re -cycled use of existing watershed, sustainable practices, development of green walkways, landscaping, park playground for children and a lot less of "stuff the bus" high density. The purpose of this investigation was to determine suitability of soil physical properties and internal soil drainage condition in areas where crawl spaces for dwellings, possible basements, and storm drainage facilities may be placed. Ten backhoe test holes were excavated and the soils described in representative locations on the property. Soil texture, soil colors (as indicators of soil drainage), estimated permeability of all identified layers, restrictive layers (compacted, high clay content, cemented hardpan), plant rooting depth, and depth to water table, if any, were all considered in this study. Estimated permeabilities (based on known measured rates through saturated undisturbed soil cores, under a one-half inch head of water), for each soil layer identified, are recorded on the attached field notes. Monitoring wells for measuring water table depths were installed in all ten test holes. Depths to water table, if any, should be measured and recorded July 15s' and continued twice each month through October 1, 2000. I do not anticipate there being free water (water table) in any of the test holes with the possible exception of THl (about 100' S. of the Ridenbaugh Canal), and TH9 and THIO (both on the lower landscape terrace position). There was no free water (water table) in any of the test holes at the time of excavation. Restrictive layers (high clay content, compacted or dense layers, and cemented layers) were found in most of the test holes (refer to attached detailed field notes), but loose extremely cobbly and gravelly fine sand underlies all of the soils except THIO.
