DESCRIPTION OF APPLICANT'S REQUEST
The applicant, Brad Carr, requests Certificate of Zoning Compliance (CZC) approval of a
change of use from church to educational institution and church on 2.067 acres of land in the L-
O zoning district.
The site is located at 2150 W. Cherry Lane.
CUP -03-048 approved this site as a planned development for an office park. The current
building on the site existed prior to the CUP and was incorporated into the overall site plan
and development of the planned development; however, the site never developed and only the
current building exists and remains. Any modifications to the current building or site may be
subject to the nonconforming standards in UDC II -IB and/or conditions of approval of CUP -
03 -048.
DECISION
The applicant's request for Certificate of Zoning Compliance is approved with the conditions
listed in this report.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to
verify ifyou need a building permit and/or inspection. Ifyou do need a building permit, you
must complete that process before you commence the use or construction. Please contact
Building Services for additional details about building permits and inspections.
Site Conditions of Approval
1. Business hours of operation within the L -O district shall be limited from 6 am to 10 pm
as set forth in UDC 11 -2B -3A4.
2. Trash dumpster onsite shall be fully contained and out of view from adjacent properties
and public streets per UDC 11 -3A -12B. Designs to fully contain trash dumpster shall
be submitted to the Planning Division for approval prior to construction.
3. Per CUP -03-048, except for the existing drain rock in the drainage swale, landscape
buffer materials shall include a mixture of evergreen and deciduous trees, shrubs, and
other ground cover to buffer the adjacent homes. All landscape material shall be living
prior to occupancy, unless surety is accepted for improvements.
4. No linear grouping of parking spaces shall exceed twelve (12) in a row, without an
internal planter island per UDC 11-3B-8C2b. Two internal planters are required to
break up linear parking exceeding twelve (12) spaces in a row; one planter on the
south side of the lot and one on the north. Each planter shall have at least one
deciduous tree with other vegetative ground cover and shall meet the standards of UDC
11 -3B -8C2.

5. Interior parking lot landscaping shall be placed at the ends of rows of parking per UDC
11-3B-8C2c. Five planter islands are required for the ends of rows of parking. Each
planter shall have at least one deciduous tree with other vegetative ground cover and
shall meet the standards of UDC 11-313-8C2.
6. The parking lot shall be restriped so as to be continuously maintained as outlined in
UDC 11 -3C -6E.
7. UDC 11 -3C -6G requires one bicycle parking space be provided for every twenty five
(25) vehicle parking spaces. Five (5) bicycle parking spaces are required. Bicycle
parking facilities shall meet the standards set forth in UDC 11 -3C -5C.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property,
the applicant shall submit a sign permit application consistent with the standards in
UDC Chapter 3 Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health
as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other
improvements in accord with UDC 11 -5C -3C.
3. Upon installation of the landscaping and prior to inspection by Planning Division staff,
the applicant shall provide a written certificate of completion as set forth in UDC 1I -
3B -14A.
4. The site plan prepared by The Architects Office on July 28, 2015, labeled CZC1.0, is
approved (except for any requested changes from the Planning Division) as shown in
Exhibit B.
5. The approved site plan may not be altered, except for the requested changes, without
prior written approval of the City of Meridian Planning Division.
6. The applicant shall pay any applicable impact fees prior to the issuance of a building
permit.
7. If any changes must be made to the site plan to accommodate ACRD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Division for
approval prior to issuance of the building permit.
8. The applicant shall complete all required improvements prior to issuance of a Certificate
of Occupancy. It is unlawful to use or occupy any building or structure until the
Building Official has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant and/or assigns shall have the continuing obligation to provide irrigation
that meets the standards as set forth in UDC 11-313-6 and to install and maintain all
landscaping as set forth in UDC 11-313-5, UDC 11-3B-13 and UDC 11-313-14.
2. The applicant shall comply with the outdoor storage as an accessory use standards as set
forth in UDC 11-3A-14.
3. The project is subject to all current City of Meridian ordinances and previous conditions
of approval associated with this site (CUP -03-048).
4. The issuance of this CZC does not release the applicant from any previous requirements
of the other permits issued for the site.
5. The applicant and/or property owner shall have an ongoing obligation to prune all trees
to a minimum height of six feet above the ground or sidewalk surface to afford greater
visibility of the area.
6. The applicant shall have an ongoing obligation to maintain all pathways.
7. The applicant has a continuing obligation to comply with the outdoor lighting provisions
as set forth in UDC 11-3A-11.

8. The applicant and/or property owner shall have an ongoing obligation to maintain all
landscaping and constructed features within the clear vision triangle consistent with the
standards in UDC 11-3A-3.
9. The applicant and/or assigns shall have the continuing obligation to meet the specific
use standards for a church and education institution asset forth in UDC 11-4-3-6 and
UDC 11-4-3-14.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division on or
before August 20, 2015, within fifteen (15) days after the written decision is issued, and contain
the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
EXPIRATION
Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the
use has not commenced within one year of the date of issuance of the Certificate of Zoning
Compliance.
Certificates of Zoning Compliance issued in conjunction with construction or alteration of a
structure shall expire if the construction or alteration has not commenced within one year of the
date of issuance of the Certificate of Zoning Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
August 5, 2016.

To Whom It May Concern:
This letter is to verify that the Idaho Learning Center, managed by Cole Valley Christian Schools, is in
compliance with the State of Idaho Department of Education requirements for private schools.
The facilities plans submitted to the City of Meridian for the intended use of the building on 2150 W.
Cherry Lane, Meridian, Idaho 83642, are in compliance with State of Idaho Department of Education
requirements for facilities of private schools and learning centers. The State Department has very little
oversight and regulation on private schools. The accreditation of schools is actually not done through
the State Department. They have submitted to a third party regional accreditation board for that. In
that accreditation review process there is verification that all fire, building, and safety codes are met,
but again the State Department of Education does not regulate private schools facilities or mandate
certain specifications.

Please accept this application for Certificate of Zoning Compliance approval. This application was
required by City of Meridian when the owner tried to submit a tenant improvement building permit
application for this building.
2150 W. Cherry Ln, Meridian, Idaho 83642 is an existing 2.12 acre developed site with a 10,656 single
story building and an asphalt parking lot with approximately 115 parking stalls. The building is an
existing place of religious worship. The building contains a main assembly hall for religious worship and
other related activities, a social hall, classrooms, offices and accessory use area (storage rooms,
mechanical and janitorial closets etc.)
Cole Valley Christian Schools is going to operate Idaho Learning Center as a special tutoring center
during weekdays and the place of religious worship will continue on weeknights and weekends. The
proposed use of the building is not changing from the existing use.
Idaho Learning Center is proposing to do an accessible restroom upgrade to the building. No exterior
modifications to the building are proposed.
