Broadway Ave. Meridian, ID 83642 RE: EARL GLEN SUBDIVISION - 1780 EAST McMILLAN ROAD APPLICATONS FOR: REZONE, PRELIIVHNARY PLAT, CONDITIONAL USE PERMIT AND DEVELOPMENT AGREEMENT MODIFICATION Dear Mr. Parsons: On behalf of Brinegar Investments, LLLP, please accept the attached development applications for the property located at 1780 East McMillan Road. The applicant's representative is Lance Watnick, Aspen Engineers. The project site is located on the north side of East McMillan Road east of Locust Grove at North Beethoven Avenue, a public street. Currently the site is zoned R-8 Medium Density Residential and the Comprehensive Plan Map designates the site as Medium Density. Land uses adjacent to the site are: • West— (C -N) 24 -Hour Convenience Store; East— (R-8) Sheridan Place, a single family detached residential subdivision; • South— (Civic) Large Idaho Power facility; and • North — (R-8) Sheridan Place Subdivision and (County RUT) vacant land. This site was previously reviewed by the City of Meridian in 2006 and 2007 as "Portico Place Subdivision" and a Development Agreement was executed between the City of Meridian and the previous property owner with specific conditions of approval for development of this site. THE PROJECT Earl Glen Subdivision, as proposed, will include 17 single family detached residential lots, 3 common lots and 3 multi -family lots. The higher density multi -family lots are located abutting McMillan Road and are bounded to the north by Beethoven Avenue. A large common lot along the west boundary of the site will include amenities for the multi -family portion of the subdivision. Buffered by the multi- family lots, placement of the single family lots is designed to be separated from the commercial use to the west and the industrial use to the south, and to provide compatibility with Sheridan Place Subdivision to the east. • P.O. This connectivity will improve the network of roadways in the neighborhood. The landscape plan for Earl Glen Subdivision shows a conceptual treatment of the large open space common lot along the west property boundary. This area will mitigate the impact of the commercial use to the west on the single family residences, will add a pleasing entry view to the detached housing portion of the subdivision, and shield residents from the headlights of vehicles entering the convenience store via Beethoven late at night. Generous landscaping along East McMillan Road will enhance the area and be a benefit to the City of Meridian, Earl Glen Subdivision, with a variety of housing types, will meet the City of Meridian Comprehensive Plan Designation of Medium Density. With the detached residential lots in the interior of the site and the smaller scale multi -family development adjacent to McMillan Road, the industrial facility to the south and the commercial use to the west, the site is balanced and blends with the surrounding uses. REZONE Brinegar Investments requests a rezone of the 1.65 acres of the site bounded generally by North Beethoven Avenue and East McMillan Road to R-15. This up -zoning will facility the pocket of multi- family housing and will best utilize the portion of the site adjacent to an arterial roadway. This limited area of higher density is appropriate given the immediately adjacent uses and plays an important role in stepping down the use intensity to the south and west of the subject site. PRELIMINARY PLAT Earl Glen Subdivision utilizes the rectangular shape of the site to its greatest advantage. With a range of lot sizes to provide variety and the expansive common area to enhance the quality of life of the residents, the mixture of housing types complements the site context. North Beethoven Avenue will be constructed to meet ACRD and City of Meridian standards. With the proposed connection to East Roaring Creek Street, the road connectivity of the neighborhood will be enhanced. CONDITIONAL USE PERMIT The conditional use permit application is a companion to the rezone request and will allow the development of the multi family area of Earl Glen Subdivision along the arterial street adjacent to the site. The 1.65 acre area is sufficient to accommodate the proposed use, meets all dimensional standards and will not adversely affect other land uses in the vicinity. This pocket of multi -family will serve several functions. The structures will buffer the lower density development from the industrial facility across the sheet and step down the land use intensity from the convenience store west of the site to the benefit of both the proposed single family residential lots and P.O. By transitioning from 24-hour commercial use to a more suburban residential setting, the multi -family helps to preserve the residential development pattern away from the intersection by using a land use that balances both land use types and intensities. Amenities provided with Earl Glen Subdivision meet the City of Meridian Standards. In the Category of Open Space, an open grassy area greater than 50 -feet by 100 -feet is provided. Under the Recreation Category, a walking hail is provided. In addition to these amenities, Earl Glen Subdivision will also include a horseshoe pit and a pergola for the use of the residents. The McMillan Road landscape buffer is 35 -feet wide in compliance with the Entryway Corridor standard. DEVELOPMENT AGREEMENT MODIFICATION A Development Agreement (D.A.) was approved on May 8, 2007, and recorded on May 21, 2007, with Instrument Number 107071997, between the City of Meridian and Portico, LLC. The current owner, Brinegar Investments, LLLC, requests a modification of the existing Development Agreement to reflect the proposed development and the changes in land use in the vicinity since the original D.A. was recorded in 2007. Since approval and recording of the Portico Development Agreement, the parcel to the west has been rezoned C -N with a single use 24-hour commercial convenience store and gas station. This substantial increase in use intensity has modified the context of the site and vicinity. Elements of the replacement conditions requested with this application are: Development of seventeen (17) single family detached residential building lots in the area zoned R-8, three (3) multi -family lots in the area proposed to be zoned R-15, and three common lots. The direct lot access for 1780 East McMillan Road no longer exists and this condition should be deleted from the Development Agreement. Brinegar Investments, LLLC, is proposing a 35 -foot wide landscape buffer along McMillan Road. The special condition regarding a 30 -foot wide landscape buffer should be replaced with the updated landscape buffer width. The proposed landscape buffer will includes 13 trees — greater than the requirements of the Unified Development Code. Special conditions related to Portico Subdivision (S. 1, Item 3, 4 and 5) should be deleted. In conclusion, the applicant believes that the Earl Glen Subdivision will improve the livability of the larger neighborhood by blending the strengths of the existing land uses with the proposed multi -family transition area to provide buffering of lower density residential development with the higher intensity residential development adjacent to the arterial roadway and the 24-hour commercial use to the west of the site. Roof pitches are 6/12, a common residential profile. Different building forms are clad with differing materials as described below. Each residential unit has its own entry porch with stone -clad columns. Each unit also has a private patio area with sliding doors and outdoor storage closets. Materials The base siding material is painted cement panel lap siding. Each residential unit includes a two-story entry element clad in painted cement panel board/batten siding, and painted cement panel shingles in the gables with painted 44 brackets. Each residential unit entry has a porch with pitched roof, stone -clad columns, and painted wood roof supports. All trim is painted MCKI BBEN + COOPER cement panel, and roof rakes and gables feature a stepped profile. All roofs are composite A K C FII T EC TS shingle. Two of the test holes were located in the proposed road right of way to be evaluated for load bearing capability. These holes were excavated to a depth of approximately 5 feet. The other hole was located in the proposed area of a storm drain facility and was excavated to a depth of 14 feet. This soil profile was also utilized in evaluation of the site for roadbed construction. Test hole R1-04 had a silty clay loam texture with an estimated 27 to 30 percent clay in the 11 to 23 inch zone of the profile. This layer was sampled for R - value testing and should represent the south half of the parcel. Test hole R2-04 is located near the north boundary of the property and has a silty clay loam soil with 35 to 40 percent clay. This layer was also sampled to represent the north part of the property.
