TEC -15-002 ORDER OF CONDITIONAL APPROVAL OF TIME EXTENSION This matter coming on regularly before the City Council on June 16, 2015, upon the Applicant's submittal of a preliminary plat time extension application for a two (2) year extension within which to obtain the City Engineer's signature on a final plat for Pinebridge Subdivision, which preliminary plat was originally approved on November 7, 2007, as provided in Unified Development Code § 11 -6B -7C, and good cause shown. Three (3) time extensions (TE -09-015, TEC -11-002 and TEC -13-004) were previously approved for this subdivision, the last of which expired on May 7, 2015. IT IS HEREBY ORDERED THAT: The above named Applicant is granted an additional two (2) year extended period of time, until May 7, 2017, within which to obtain the City Engineer's signature on the final plat, subject to the conditions of approval as shown in the attached Staff Report for the hearing date of June 16, 2015 incorporated by reference. APPLICATION SUMMARY The applicant, B.W. Meridian, Inc., requests approval of a two year time extension (TEC) on the preliminary plat for Pinebridge Subdivision in order to obtain the City Engineer’s signature on a final plat. II. STAFF RECOMMENDATION Staff recommends approval of the subject time extension, until May 7, 2017, with the conditions included in Exhibit B. III. UNIFIED DEVELOPMENT CODE (UDC) Per UDC 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer’s signature on the final plat within two years of the approval of the preliminary plat. Where the development of the preliminary plat is made in successive phases in an orderly and reasonable manner, and conforms substantially to the approved preliminary plat, such segments, if signed by the City Engineer within successive intervals of two years, may be considered for final approval without resubmission for preliminary plat approval. Upon written request and filing by the applicant prior to the termination of the allowed time period, the City Council may authorize a time extension up to two years. With all extensions, the City Council may require the plat to comply with current provisions of the UDC. VI. PROCESS FACTS A. The subject application is for a time extension. A public hearing is required before the City Council on this matter, consistent with Meridian City Code Title 11, Chapter 5. B. Newspaper notifications published on: May 25 and June 8, 2015 C. Radius notices mailed to properties within 300 feet on: May 21, 2015 D. Applicant posted notice on site by: June 5, 2015 VII. HISTORY OF PREVIOUS ACTIONS:  This property received preliminary plat (PP-07-008) approval from City Council on November 7, 2007. The preliminary plat consists of 61 building lots and 21 common/other lots on 170 +/- acres of land.  An 18-month time extension (TE-09-015) on the preliminary plat to obtain the City Engineer’s signature on a final plat was approved by the Director on October 16, 2009. This approval extended the time period in which the applicant had to obtain the City Engineer’s signature until May 7, 2011.  A second time extension (TEC-11-002), for 2 years, on the preliminary plat was approved by City Council on May 3, 2011. The approval extended the time period in which the applicant had to obtain the City Engineer’s signature until May 7, 2013.  A third time extension (TEC-13-004), for 2 years, on the preliminary plat was approved by City Council on June 18, 2013. The approval extended the time period in which the applicant had to obtain the City Engineer’s signature until May 7, 2015. VIII. STAFF ANALYSIS This is the fourth time extension requested for the subject preliminary plat. No final plats have been approved by City Council for this site. However, Pine Avenue was widened, the round-a-bout constructed, Webb Avenue constructed, and new public utility and municipal services and infrastructure have been installed, which facilitated the development of the Scentsy Campus and the PKG Campus. Approval of the subject time extension will allow the applicant to proceed with the platting process. If the subject time extension is not granted, the entire property would need to be resubmitted for preliminary plat approval. Per UDC 11-6B-7C, with all extensions, the City Council may require the preliminary plat to comply with current provisions of the UDC. With previous time extension requests, the applicant was EXHIBIT A Pinebridge Sub PP TE (TEC-15-002) Page 3 required to comply with current design review, street light, and performance and warranty surety standards. As a provision of the subject time extension request, staff recommends the applicant comply with current Public Works construction standards as noted in Exhibit B and also improve and landscape the planter area in the middle of the round-a-bout in Pine Avenue. The applicant is to meet all terms of the approved annexation (AZ-07-006), development agreement (instrument #108022893), rezone (RZ-07-010), preliminary plat (PP-07-008), variance (VAR-07-007), time extensions (TE-09-019; TEC-11-002; TEC-13-004), and property boundary adjustment (PBA-10-005) for this development. 2. The applicant shall revise the development plans to comply with the 2013 edition of the Supplemental Specifications and Drawings to the Idaho Standards for Public Works Construction. 3. The applicant shall improve and landscape the planter area in the middle of the round-a-bout in Pine Avenue prior to November 1, 2015. 4. The applicant shall obtain the City Engineer’s signature on a final plat for Pinebridge Subdivision or apply for a time extension in accord with UDC 11-6B-7 prior to May 7, 2017.
