Meridian Auto CZC 15-058 revisedREVISED CERTIFICATE OF ZONING COMPLIANCE REPORT p DATE: June 412, 2015 Ca�VI E IDIAN '-' TO: John Nesmith FROM: Bill Patrons, Associate City Planner SUBJECT: Meridian Automotive—CZC-15-058; DES -15-047 OWNER: John Nesmith DESCRIPTION OF APPLICANT'S REQUEST The applicant, John Nesmith; requests Certificate of Zoning Compliance (CZC) and Administrative Design Review (DES) approval for the following: 1) construction of a new 715 square foot addition on the west side of the existing building and 2) fagade improvements on the south and east side of the existing building that includes a new covered entry (plaza, sitting area and entry feature), a raised planter bed, new windows, decorative trellis and screen wall on the east fagade and a new awning on the south fagade. The site is located at 505 N. Main Street. DECISION The applicant's request for CZC and DES are approved with the conditions listed in this report. Note: This is not a building permit. You must complete this process before you commence the use or any construction. Please contact Building Services at (208) 887-2211 to verily the building permit and/or inspection requirements. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC I I -3A-7. 2. The applicant shall obtain a flood plain development permit prior to construction on the site. Process Conditions of Approval 1. No signs and/or banners are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. The site plan and landscape plan prepared by Duane Marler, dated 05/05/15, labeled A=2 DR -4. and DR -4 are approved on 06/4912/15 by the City of Meridian Planning Division as shown in Exhibit B with the following comments: a. If the new sidewalk adjacent to the building is flush with the parking stalls; provide wheel stops or vertical curbing to prevent vehicles from overhanging the 5 -foot clear zone of the walkway in accord with UDC 11-3C-5133. Contact Bob Olson at Republic Services (345-1265) for detailed review of the new trash enclosure. The new enclosure shall screen the dumpster from the street in accord with UDC 11 -3A -12B; chain link with slats does not qualify as a screening material (UDC 1I - 3B -5M). 4. The elevations prepared by Duane Marler, dated 05/05/15, labeled A-3, A-4, DR -2, DR -3 and DR -4, are approved on 06/9412/15 by the City of Meridian Planning Division as shown in Exhibit C. 5. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Division. 6. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 7. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for approval prior to issuance of the building permit. 8. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval I . The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-313-13 and UDC 11-3B-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP -02-004; CZC-04-072; MCU -13-001 and TED -15-001). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. 8. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the existing use (vehicle repair) as set forth in UDC 11-4-3-37. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before June 2426, 2015, Conditions Document 2 Meridian Automotive CZC & DES REVISED within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11- 5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The addition will be located in an open storage yard area, west side and behind their current metal building. The original building permit has now expired. In 2015 the owner wishes to proceed with the same building expansion that was previously approved. This project is part of an overall facility upgrade consisting of a new front trellis, entrance canopy and screen wall. The new addition Is basically the same with some minor differences from the original submittal. Following is a description of the proposed new 715 s.f. addition. 1. The exterior is the same as originally proposed with hard board lap siding to match the existing south and rear building material. The exterior siding color shall match the existing. 2. The roofing material will now be a single ply membrane product rather than the original metal roof. Approximately a year ago, a new membrane roof was installed on the adjacent shop building. The new 715 s.f. addition ties into this shop building with a continuation of the same single ply roofing. 3. In order to blend the existing shop building together with the new addition, the roof height is higher than the original submittal. Both roof heights will now be at the same elevation. This change allows for a more uniform appearance. 4. The exterior entrance door area has been modified to meet current IBC Accessibility and Usability requirements for Commercial buildings.
